Suo-Moto Power of SAC Challenged
HC heard arguments of counsel for SAC

Jammu, AUG-14 In Jam-packed Court of Justice Hasnain Massodi, the writ petitions segregated in which the Suo-Moto power of State Accountability Commission has been challenged, Sr. Adv Sunil Sethi concluded his arguments on behalf of SAC.
Senior Counsel while advancing his case strongly laid stress on sections 9, 10 & 11 of the State Accountability Commission Act 2002 and Regulation No 9 framed by J&K State Accountability Commission. While buttressing his arguments Sr. Adv Sunil Sethi submitted that the conjoint reading of aforesaid sections of the Act do not make it compulsorily that only cognizance can be taken by the SAC on a proper complaint. Counsel for the SAC gave various illustrations in support of his arguments and tried to justify the Suo-Moto power of the SAC. He further submitted that SAC can look into grievances, allegations and action as defined under the Act.
Justice Hasnain Massodi noted down the submissions made by Sr. Adv Sunil Sethi and after conclusion of the argument, Sr. Adv DS Thakur requested the Court that supplementing the arguments of Sethi, he also wants to support the Suo-Moto power of the SAC. Justice Hasnain Massodi took note of the submissions made by Sr. Adv DS Thakur and also asked Sr. AAG Gagan Basotra to apprise the Court about the stand of the State with regard to the Suo-Moto power of the SAC on the next date and adjourned the case to be taken-up from August 22, 2012 onwards.
It is worthwhile to mention herein that the petitions filed by Pt Managt Ram Sharma Former Deputy Chief Minister J&K, Suman Lata Bhagat Former Health Minister, Peerzada Mohd Syed Former Education Minister, Manohar Lal Sharma Minister for cooperatives, Vikas Behal PRO to Former Health Minister Suman Lata Bhagat, Satvir Gupta Former DIG, Atal Dulloo IAS Commissioner/Secretary to J&K Govt, Abdul Majid Wani Former Minister and MLA Doda, Sheikh Rafiq Ahmed Former Deputy Commissioner Rajouri, Dr. Mohd Deen rtd Commissioner/Secretary Animal Husbandry Dept, Dr. Satvir Gupta Former Director Sheep Husbandry Dept, Ashok Parmar IAS then Vice chairman JDA, Dharmveer Koul Executive Engineer PWD, Jamrodh Singh SHO JKP and Farhat Qureshi then Secretary J&K Housing Board and others are pending in the state High Court for last more than five years and looking into the pendency of these matters.
