6 Years RI to ISYF activist after trial, investigation

Jammu, Aug 24 (JNF): Principal Sessions Judge Jammu Jang Bhadur Singh Jamwal today awarded six years rigorous imprisonment and fine Rs 35000 to Sat Pal Singh S/o Harbajan Singh R/o Bagwal, Kapurthala Punjab activist of International Sikh Youth Federation after 17 years investigation and trial.
According to the police case that accused Sat Pal after retiring from Army went to Belgium via Mascow and came in contact with Daljit Singh, who happens to be President of I S Y F motivated him and instigated, persuaded for separation of Punjab from India and sent him to Karachi, on fake passport. The accused had undergone extensive training in the camp organized by Pakisthan, latter on taken to Punjab and from where the accused was provided training in highly explosive substance for subversive and on night interceding 17/18 Feb.96, made him to cross the border and intrude into Indian Territory with highly explosive substance. When the accused entered the Indian Territory without passport or permit with explosive substance challenged by the nakka party at the Indian Border, but the accused opened fire, but lateron surrendered by raising his hand and was apprehended by the nakka party with arms, ammunition etc for subversive activities in the State of J&K and endangering the security of the country. Hence, challan u/s 2/3 E C A,3/12 P Act, 3 E A O, 7/27 A A. has been presented against the accused.
While awarding sentence, Court took a lenient view and observed that seeing the age and behaviour of the accused, there is no report of the convict for repeating offence, a lenient view is taken and accordingly, accused/convict Sat Pal Singh S/o Harbajan Singh R/o Bagwal, Kapurthala Punjab who has been convicted u/s 7/25 Arms Act and 3 E A O, shall suffer rigorous imprisonment for a period of three years and shall pay a fine of Rs. 10,000/- (Rs ten thousand only) u/s 7/25 Arms Act and in default of payment of fine, he shall suffer further rigorous imprisonment for a period six months and under section 3 E A O he shall suffer rigorous imprisonment for a period of three years and shall pay a fine of . 25,000/- (Rs ten thousand only) and in default of payment of fine, he shall suffer further imprisonment for a period six months. Both the sentences shall run concurrently.
