DB expresses anguish over non-compliance of Court orders
PIL seeking implementation of Disability Act 1998

Jammu, Aug 27 (JNF) : A Division Bench of the state High Court comprising Chief Justice MM Kumar and Justice Muzaffar Hussain Attar expressed its displeasure/anguish over the non-compliance of directions already issued by the State High Court in a PIL seeking implementation of Disability Act, 1998.
While expressing its anguish the Division Bench reminded Sr. AAG Gagan Basotra and AAG Seema Shekhar about the previous orders whereby an assurance had been extended to the Division Bench about the compliance of the Court of directions when the Court was inclined to summon Chief Secretary over non-implementation of the Court directions aimed to benefit the disable persons.
In a jam-packed Court, Division Bench after perusing the various status reports filed by the State and after hearing Sr. AAG Gagan Basotra who time and again tried to persuade the Division Bench about the compliance of the directions, however, the Division Bench did not agree with the submissions of Basotra Sr. AAG and reminded him about the assurance earlier extended by the State Counsel with regard to implementation of the Court directions. Division Bench in the open Court observed that this is a fit situation to call the Chief Secretary of the state as the directions of the Court are still un-implemented. However, Sr. AAG requested the Division Bench to allow some more time to report compliance of the Court directions.
Division Bench looking into the urgency involved in the matter directed Sr. AAG Gagan Basotra to file an affidavit of Chief Secretary indicating compliance of the Court directions within one week from today, failing which Division Bench observed that it will initiate proceedings for non-compliance of the Court directions. Subsequently the matter was deferred for second half and after break, the matter was again taken-up and Sr. AAG Gagan Basotra assured the Division Bench that he will file an affidavit/undertaking tomorrow as per observations/directions of the Court. Upon this Division Bench kept the matter on-board for tomorrow. These Court directions were passed in open Court by the Division Bench in a Public Interest Litigation filed by National Federation of Blind J&K Branch seeking implementation of the Disability Act 1998 whereby adequate provisions have been made for disabled people.
