Crime Branch produces challans against fraudsters/cheaters

Jammu, Aug 28 : Crime Branch Jammu has produced challan in Cases FIR No. 51/2004 u/s 420,424,468,471,201/RPC P/S Crime Branch, Kashmir against the accused persons Prithvi Singh S/o Bachan Singh R/o H.No.4, Court Road Janipur, Jammu , Sanjeev Kumar, Senior Asstt. RTO, Jammu Retired now expired and Abdul Sattar Ganai S/o Ghulam Mohd. Ganai R/o Vill. Bhan Tehsil & Distt. Kulgam, Kashmir before the Court of Chief Judicial Magistrate, Kulgam today.
Brief facts of the case are that Registrar Co-operative societies, Kashmir lodged a complaint with Crime Branch, Kashmir alleging therein that during the proceedings of arbitration of case titled Abdul Sattar Ganai Vs. Land Development Bank through Chairman Srinagar, it surfaced that vehicle (Tractor) bearing Registration No.6749/JKC, Model 1982 was initially registered in the name of M/s Abdul Sattar Ganai and others under hypothecation with J&K, Central Land Development Bank Kulgam, whileas RTO Jammu intimated that the vehicle in question stands transferred from Abdul Ashraf Dar and Abdul Majid Lone to one Prithvi Singh S/o Bachan Singh R/o Janipur, Jammu on the production of Form No. 29 along with an affidavit. Transfer of vehicle without knowledge of actual owners requires verification. On receipt of this complaint, a preliminary enquiry was initiated and accordingly the case was registered in P/S Crime Branch, Srinagar.
During investigation by Crime Branch, Jammu fictitious documents file which was prepared by the officials of Regional Transport Office, Jammu was seized and sent to FSL. It was substantiated that one Abdul Sattar Ganai S/o Ghulam Mohd. Ganai R/o Vill. Bhan Tehsil & Distt. Kulgam, Kashmir and his brother Gh. Nabi Ganai, Gh. Mohd. Palla S/o Mukhta Palla, Khuthji D/o Mukta Palla R/o Village Bhan obtained loan from Land Development Bank Authority, Kulgam to the tune of Rs. 1.8 lac by mortgaging land measuring 48 kanals. All the share holders had jointly purchased a Tractor from Valley Tractor National Highway, Awantipura. The Tractor was registered by Regional Transport Office, Srinagar under Registration No.JKC/6749. The said Abdul Sattar Ganai regularly paid the installments of loan to the Bank upto 30.11.1984, but later on, he became defaulter. On 20th of November, 1986 the Land Development Bank officials auctioned 5 kanal and 16 Marlas of land out of the mortgaged land for Rs.56,500/-. The auctioned land was bought by one Abdul Sattar Palla R/o Bhan Tehsil Kulgam. The Bank authorities liquidated the loan amount from the auctioned land. The said Abdul Sattar Ganai in the year 1995 lodged a complaint against the authorities of the Land Development Bank, Kulgam alleging therein that they had sold his Tractor without his knowledge and consent as he was suffering from "mental disorder" but during the course of investigation, it came to light that the said Abdul Sattar Ganai had himself sold the said Tractor to one Prithvi Singh S/o Bachan Singh R/o Janipur Jammu for an amount of Rs. 36000/- in the year 1987, in order to defraud Land Development Bank, Kulgam. The said Tractor was hypothecated to Land Development Bank at the time of its purchase therefore, Abdul Sattar Ganai could not sell the said Tractor to Prithvi Singh without any NOC from the concerned Bank.
After purchasing the Tractor, the said Prithvi Singh brought the Tractor to Jammu in connivance with the officials of RTO Jammu and had prepared fake documents of the Tractor for registration. The above mentioned offences were fully established against accused persons, who have been challaned in the court of CJM Kulgam for judicial determination. Both the accused persons have been sent to the Judicial custody by the Court. Next date of hearing in the case has been fixed on 12.09.2012.
