One year RI, fine Rs 50000 each to Sub-Post Master, accomplice | Misappropriation of Kissan Vikas Patras | | early times report Jammu, Aug 31 (JNF) : Special Judge Anticorruption (CBI Cases) J&K Jammu BL Bhat today awarded one year rigorous imprisonment and fine Rs 50,000 each to Inderjeet Sharma Sub-Post Master and Surjeet Singh Agent for misappropriating and fraudulently and dishonestly withdrawing the amount of Kissan Vikas Patras of the investors. According to the CBI case that it was revealed during investigation that the Kissan Vikas Patras had been supplied by Head Office Kangri to sub Office Kangri through invoices and the same were entered in the stock Register. Payment of said KVPs was shown to have been made through discharge journal. It was further established that these investors from time to time on maturity of the KVPs deposited the same for renewal/issuance of new KVPs against the maturity amount before A-2 and Babu Ram Postal Assistant (for short A-3), the then SPM Kangri, through A-1 but none of the investors have been issued new KVPs in lieu of old KVPs deposited by the investors. It was found that A-1 had dishonestly obtained signatures/thumb impressions of the said investors on the back of KVPs in token of having received the maturity amount of KVPs. It further surfaced during investigation that A-1 in conspiracy with A-2 obtained Rs. 15,000/- from Anant Ram son of Lakhu Ram resident of Sunderbani and issued him bogus GPF passbook while A-3 had fraudulently withdrawn Rs. 15,000/- from recurring account No. 22713 of Smt. Ramesh Kumari vide SB voucher dated 28.08.1997. It was further revealed that A-2 had fraudulently withdrawn Rs. 27,106/- from the same account on 21.10.1997. Allegedly this was done by fraudulently obtaining signatures of investor Ramesh Kumari. A-2 subsequently made the discharge of payment of Rs. 76,500/- against KVPs to the investors and Rs. 27,106/- of recurring account No. 22713 of Smt. Ramesh Kumari. A-3 also discharged total payment of KVPs to the investors amounting to Rs. 40,500/- besides discharging liability of Rs. 15,000/- on account of withdrawal from recurring account of Ramesh Kumari. Court observed that accused have committed breach of trust reposed by common man in Postal Staff and brought the institution into disrepute. Striking a balance between the aggravating and the extenuating circumstances and having regard for the age of the accused/convicts I am of the considered opinion that rigorous imprisonment for one year would be appropriate substantive sentence on all counts. The accused/convicts are accordingly awarded rigorous imprisonment for one year as the substantive sentence on all counts besides imposition of total fine of Rs. 50,000/ each. All the substantive sentences shall run concurrently. The amount of fine shall be realized from the Estate of accused/convicts unless paid within 30 days from today. |
