Special Tribunal directs RO to allow petitioner to contest | Rejection of nomination for CCB Elections | | early times report Jammu, Aug 31 (JNF): A Bench of J&K Special Tribunal comprising its Member JR Kotwal (District & Sessions Judge) has issued notice to the Additional Deputy Commissioner Jammu and Divisional Commissioner Jammu/ Administrator the Citizens Cooperative Bank Ltd Jammu in a revision petition preferred by one Charnajeet Singh Raina whose nomination papers were rejected by the Returning Officer during scrutiny on August 27, 2012. The Tribunal after hearing Adv Abhinav Sharma appearing for the petitioner considered the various grounds urged by him and found the case good for grant of interim relief. The Bench observed that ad-interim stay is thus granted and the impugned order in so far as it pertains to the petitioners is stayed making it clear that nomination of the petitioner shall be deemed not have been rejected on the grounds urged in the revision petition. In the petition it has been urged that the impugned order rejecting the nomination of the petitioner on the ground that the petitioner who himself was a nominee to contest the election to the Managing Committee of CC Bank could not have proposed/ nominated the names of other candidates for contesting the election to the same Managing Committee is illegal, without jurisdiction and is unwarranted as the petitioner is eligible u/s 29 of the Cooperative Societies Act being a share holder of the society, the nomination of the petitioner could not have been rejected merely on the ground that the petitioner proposed/ nominated the candidature of other candidates. |
