14 yrs RI and fine Rs 60,000 in rape, kidnapping case of minor

Jammu, Aug 31 (JNF) : Principal Sessions Judge Jammu Jang Bahadur Singh Jamwal today awarded 14 years rigorous imprisonment to Davinder Singh son of Sansar Singh r/o Chowki Choura, Akhnoor in rape and kidnapping case of seven years old girl.
According to the police case that on November 30, 2009, the father of the prosecutrix had organized a Jagrata at his house and lot of people had participated in that. His daughter aged 7 years old was sleeping inside a room and at 3 a.m. when Jagrata concluded, he found that his daughter was missing from the room.
He started search of his daughter alongwith others, interceding the search Baldev Singh came to him and narrated that his daughter in an unconscious condition at a distance of half a km is lying in his land adjacent to the Govt. Hr. Sec. School.
He immediately went on spot and found that some unknown person with criminal intent has committed rape upon her and having entered in his house and kidnapped his daughter and committed raped upon. Unknown person had left her on spot. He immediately lifted her in unconscious state and took her to S D H Akhnoor, from where she was referred to GMC Jammu. On the basis of this report investigation was commenced thereupon, as a finale presentment of the challan and made the accused persons to stand trial.
Principal Sessions Judge Jammu Jang Bahadur Singh Jamwal after hearing both the sides observed that Child sexual abuse is a form of child abuse in which an adult or older adolescent uses a child for sexual stimulation.
The convict has mercilessly raped a small child and has shown a beast inside him and said that The convict/accused Davinder Singh shall suffer rigorous imprisonment for (ten) 10 years and pay a fine of Rs. 50,000/- (rupees fifty thousand only) u/s 376 RPC. In default of payment of fine, he shall further suffer an imprisonment for two years.
He shall further suffer rigorous imprisonment for three years and pay a fine of Rs. 5000/- (rupees five thousand only) u/s 363 RPC. In default of payment of fine, he shall suffer an imprisonment for six months.
He shall further suffer rigorous imprisonment for one year and pay a fine of Rs. 5000/- (rupees five thousand only) u/s 451 RPC. In default of payment of fine, he shall suffer an imprisonment for six months. However, all the sentences shall run concurrently.
