TADA Court acquits `Pak Trained' Sikh extremist after 20 years

Jammu, Sept 1 (JNF):- Presiding Officer Designated Court under TADA Sanjeev Gupta has acquitted alleged Sikh extremist Harjinder Singh son of Amreek Singh r/o Simbal Camp Tehsil RS Pura who was apprehended by the BSF on July 1991 while crossing over to India from Pakistan Side.
According to the police case that on July 8, 1991 a BSF Patrolling Party had produced accused and lodged a written report to the P/S Hiranagar with the allegations that on July 7, 1991 a patrolling party of BOP Karol Krishna, apprehended accused while he was crossing over to India from Pakistan side in the Indian Territory along with one AK-47 rifle, four magazines of AK-47 Rifle, two pistols, none pistol magazines, one pistol silencer, 159 rounds of pistol ammunition, 565 rounds AK 47 rifle, one wire cutter, one rucksack bag, Indian Currency of Rs 5050, one wrist watch of Japan make. The said arms and ammunitions recovered from the accused will be handed over to the army head quarter as per Army Rules. It is further alleged that accused is probably a Sikh extremists and may be involved in some criminal/ extremists activities which requires his interrogation. On the said report, case was registered against the accused and during the Course of investigation, witnesses were examined u/s 161 CrPC and after completion of the investigation challan was presented in the Court of law on February 29, 1992.
The court after hearing Deputy Director Prosecution for the state whereas Advocate Parvinder Singh for the accused observed that in the investigation the accused had went to Pakistan in the month of February 1991 and thereafter obtaining training in militant activities, he returned back to India along with arms and ammunition in order to indulge in militant activities in India in lieu of Rs 5000 in India Currency but was apprehended on July 7, 1991.
Court further observed it has already been stated that investigating officers of the case has not been produced in the witness box; he was the best person to remove the doubts about the legal flaws and on the identification aspect of the accused. His not production in the witness box had given a severe blow to the prosecution case and with these observations Court dismissed the challan and acquitted the accused as prosecution failed. JNF
