SCOA condemns SPCB for closure of stone crusher, demand order rollback

Jammu, Sept 2 : The Stone Crusher Owner Association (SCOA) has expressed their resentment against the order issued by State Pollution Control Board (SPCB) for the closure of BN Stone crusher. Maintaining the said order is arbitrary, misuse of power and high handedness and is not based on facts.
As per press handout issued, in this regard a meeting of the members of the association was held here today, under the President-ship of President, SCOA, Vikram Randhawa. Addressing during the meeting, he said that the report given by the additional DDC Jammu is frivolous and misleading as the said unit in question had valid NOC till May 2012 and continuously running its business from the last 22 years. No proper hearing was given to the aggrieved unit holder.
He said that the unit holder has to apply to the PCB and the other departments has issued NOC after verifying all the parameters, this takes sometime .An acceptance of application means we have applied for license afresh and till such application is rejected, it is deemed to be in the knowledge of department that the unit is operating legally. "How can another administrative authority pass an order in the mean time", he asked.
Meanwhile, no closure notice was issued either by the PCB or any other concerned department thereby jeopardizing the democratic rights of the unit holder.
A unit which is in operation for 22 years with all the valid documents and registrations of various government departments cannot be termed illegal overnight.
With the development of areas and in anticipation of this problem the SCOA had already applied to the SPCB through the wide letter no. SPCB/LEGAL/2010/55/276-98 dated 26-07-210 but till date the departments remain silent over the issue and now, harassing the unit holder for ulterior motives. Randahwa said, "Crushers are normally installed on the banks of a khad (Dry Nallas) and unscrupulous people buy land because of low cost and then black mail the unit holders.
In the present case it is shameful that a retired official has purchased land near the stone crusher knowing fully well the consequences.
Residential area is determined by the fact that more than 25 residential houses are there in the cluster. Most applications against such units are not genuine and the administration never cares to ascertain the credentials of compliant ants.
Moreover, the RTI submitted in this regard also proves that the Petrol Pump owner and School owner have no objection for running this stone crusher.
The members of association have further urged upon the SPCB to review its order for the closure of BN Stone crusher as it is running its business with all valid documents.
Among others participate in the meeting were Anil Gaind, Dev Choudhary, Badri Nath and Sunil Gaind.
