| Select Committee adopts Report on Muslim Personal Law | | | Jammu, February 06 The Select Committee of Jammu and Kashmir Legislative Assembly has adopted the Report on the Law ( Shariat) Application Bill, 2005 (L.A Private Member’s Bill No. 18 of 2005) in its meeting held here today with Minister for Law and Parliamentary Affairs Mr. Tariq Hameed Karra in chair. The Committee discussed the Private Member’s Bill in detail and after detailed deliberations adopted the Report with some changes in the Bill. The Bill was introduced by Mr. A. R. Rather during the budget session of 2006 and the same was referred to the Select Committee by the House for its suggestions and recommendations. The Bill seeks application of Muslim Personal Law (Shariat) to Muslims of J&K State. It deals with the questions regarding succession, special property of females including personal property inherited or obtained under contract or gift or any other provisions of Personal Law, marriage, dissolution of marriage, mubarrat, dower, guardianship, gifts, trust and trust properties, the rule of decision in cases where the parties are Muslims shall be the Muslim Personal Law (Shariat). The Bill also seeks the provisions of the Sri Pratap Jammu and Kashmir Laws Consolidatation Act, Samvat, 1977 (1920 A.D.) shall be repealed in so far as they are inconsistent with the provisions of this Act. Those present in the meeting included, legislators Mr. A. R. Rather, Mr. Sartaj Madni, Aga Rohulla Mehdi, Mr. Ghulam Hassan Khan, Commissioner/Secretary Law Mr. A. H. Kochak and Secretary Legislative Assembly Mr. M. Iqbal Ganai.
