SC to hear Haji Yousuf case in October | `State has no arguments to offer' | | Early Times Report Jammu , Sept 4 : Division Bench of the Supreme Court of India comprising JJ Altamas Kabir and J. Chelameswar today adjourned hearing on the petition filed by Shri Balwant Singh Mankotia, MLA, Panthers Party, seeking CBI probe into the gruesome custodial death of Haji Mohammad Yousuf, National Conference activist on 29th September, 2011 in police station Srinagar. The case was fixed by the Supreme Court for this day to be heard on the request of Professor Bhim Singh, Senior Advocate appearing for the petitioner. The Supreme Court in its order had fixed the case on the top of the board to be heard on 4th September, 2012. When the case came up for hearing , the Advocate-General of J&K State, Ishaq Qadri expressed inability to argue the case this day and urged the court to fix the case on some other date. Bhim Singh has been insisting that the case may be heard at the earliest in the interest of justice and rule of law. He said that the State of J&K has been playing hide and seek with the court for several months. The court fixed the case for final hearing in the second week of October, 2012. Earlier, the State of J&K has filed 196-page-additional documents in the court which Bhim Singh described as futile exercise by the State of J&K in this case. 39 affidavits of policemen, two affidavits of relatives of the deceased, five affidavits of the members of staff of police hospital, three affidavits of patients of police hospital, four affidavits of persons at CM's camp office, Srinagar including that of Omar Abdullah, Chief Minister have been filed. The affidavit filed by Omar Abdullah, the Chief Minister of J&K before the inquiry officer, the Additional District Magistrate, Srinagar has made interesting disclosures which is being reproduced for information; "On examination states that on 29 September 2011, during the State Assembly Session, a party worker, namely, Shri Mohd. Yousuf Bhat, of Raypom Ganderbal, approached me in the Assembly Complex and complained that another party worker, namely, Syed Mohd. Yousuf, of Lalctipom Bijbehara, had obtained an amount of Rs. Eighty Four Lac (Rs.84,0 0,000.00p) from him on the pretext of bestowing undue favours upon him from the party high command. The complainant was asked to report at the Camp Office in the afternoon to address his grievance. For ascertaining the veracity of the complaint, the M.O.S. Home, Shri Nasir Aslam Wani, was asked to summon Syed Mohd. Yousuf as well. Thereafter, I immediately recalled that a similar type of complaint was also made some time back by another party worker, namely Ab. Salam Reshi, against the same person, namely Syed Mohd. Yousuf, for having obtained Rs. Thirty Four Lac (Rs.34,00,000.00p) from, him for the same purpose. Accordingly, Private Secretary, Shri Asgar Hussain was directed to call Abdul Salam Reshi at the Camp Officer in the afternoon so as to listen to his grievance also. I reached my Camp Office and remained busy with my official business. At about 5 p.m., when I was being interviewed by the B.B.O. Crew in my Camp Office lawns, the MOS Home informed me that all the three persons have arrived and are waiting in the Meeting Hall. I, along with MOS Home, went to the Meeting Hall. On enquiry, Shri Abdul Salam Reshi disclosed that Syed Mohd. Yousuf had obtained Rs. Thirty Four Lac (Rs.34, 00,000.00p) from him on pretext of bestowing undue favours as MLC upon him by the party high command. Shri Ab. Salam Reshi also disclosed that out of the said Rs. Thirty Four Lac (Rs.34 ,00,000.00p) was subsequently returned to him by Syed Mohd. Yousuf. Similarly, Shri Mohd. Yousuf Bhat also stated that on the same pretext Syed Mohd. Yousuf had obtained an amount of Rs. Eighty Four Lac (Rs.84 ,00,000.00p) from him for being inducted in the Ministry. On being enquired about these allegations, Syed Mohd. Yousuf accepted to have obtained the said amounts deceitfully from the complainants. Thus, considering the gravity of the allegations leveled against Syed Yousuf, I directed the MOS Home to have the matter probed in accordance with law, through the Crime Branch of J&K Police and left the Meeting Hall with this instruction. I did not see Syed Mohd. Yousuf after that and since the Crime Branch of J&K Police had initiated action as per law, I did not enquire about his issue any further."
