Commissioner JMC, Chairman PCB to appear in person | PIL on polythene bags | | Jammu, Sept 4 : (JNF):- In a Public Interest Litigation filed by Yash Bhasin (Sr. Journalist) regarding pollution (noise and air pollution) which is being generated by the use of non-bio-degradable material including the polythene carry bags, Division Bench of State High Court comprising First Puisne Judge Justice Virender Singh and Justice Muzaffar Hussain Attar while expressing displeasure over the reports filed by Commissioner Jammu Municipal Corporation sought his personal appearance. The Chairman Pollution Control Board has also been directed to appear in person. The Court after hearingg Advocate SK Anand for the petitioner AAG Gagan Basotra for the state, and Advocate SS Nanda appearing for JMC observed that the report filed by Commissioner JMC is not satisfactory. Division Bench further observed that even Advocate SS Nanda was not in a position to reply Court's certain pointed queries. Commissioner JMC has not come personally so is the position of Chairman State Pollution Control Board. While parting with the order, Division Bench directed that for the purposes of passing any effective order, presence of Commissioner JMC and Chairman PCB becomes imperative. Division Bench looking into urgency involved in the matter directed the presence of both the officers on September 19, 2012. JNF |
