PIL `strips' tax defaulters

Jammu, Sept 4 (JNF):- A public Interest litigation (PIL) based on RTI expose regarding the arrears of Sales Tax/ Vat worth Hundreds of crores, today Commissioner commercial Taxes Dept Kifayat Hussain Rizvi filed Action Taken Report along with voluminous list of defaulters. The defaulters include Minister of State for Home Nasir Aslam Wani s/o Bashir Ahmed Wani r/o Wani House Raj-Bagh Srinagar of M/s Gilston Joinery Mills Zainakote, Srinagar. The other prominent defaulters are Arshi Taj d/o Taj Mohi-ud-Din (Minister for PHE, Irrigation & Flood Control) r/o 4-A Gandhi Nagar Jammu of BOSS Milk Pvt Ltd Satwari Jammu, Highland Motors of Amjad Abbas and Imran Raza Ansari s/o Molvi Iftikhar Hussain Ansari presently MLA PDP (Former Minister) r/o Qamarwari, Srinagar and others. In the list of defaulters of Kashmir Division at Serial No 18 the name of Mr. Nasir Aslam Wani is reflected as defaulter of Sales Tax for the year 2005-06, 2006-07 for an amount of Rs 5,47, 543/-, with regard to Arshi Taj daughter of Taj-Mohi-ud-Din, she has been declared defaulter for the year 2005-06, 2006-07 for an amount of Rs 523125/-. Amjad Abbas Ansari and Imran Raza Ansari s/o Molvi Iftikhar Hussain Ansari presently MLA PDP (Former Minister) r/o Qamarwari, Srinagar, the amount mentioned is Rs 18576708 and it is further submitted that the recovery proceedings stayed by State Sales Tax Tribunal for an amount of Rs 78788166 and for rest of the amount summons have been issued vide No 45/DCK/REC dated August 23, 2012. The other prominent defaulters include Power Grid Corporation for an amount of Rs 492429147.07, BSNL Rs 254506705 (matter sub-judice in High Court), Shiva Gun Factory Rs15774577 in the names of Sh. Dharam Chand s/o Sama Ram and Lt. Sh. Dhirandera Bramchari, Hindustan Petroleum Corporation Rs 5259001.55, JAKFED BC Road Jammu through GL Abrol (authorized signatory) for an amount of Rs 2989878/-, ASCOMS Sidhra Jammu1331972/-. In the ATR the total amount recoverable as certified by Deputy Commissioner Commercial Taxes (Recovery) Jammu is Rs 2557849392.99, similarly the total amount recoverable from Kashmir Division has been mentioned as Rs 3068444147. Today a Division Bench of State High Court comprising First Puisne Judge Justice Virender Singh and Justice Muzaffar Hussain Attar deferred the Public Interest Litigation for further consideration for September 25, 2012 after hearing a battery of lawyers.
