Will SVC constitution remain in cold storage forever?

Srinagar, Sept. 4: The constitution of the much hyped State Vigilance Commission (SVC) has been in the cold store for over three months after the State Governor, N.N. Vohra raised questions over the nomination of the SVC chairperson and one of the other two members proposed by the recommending panel.
The State Government response to the queries raised by the Raj Bhavan is yet to reach the Governor's secretariat as per sources in the Raj Bhavan. According to the constitution the Governor enjoys the powers to accept or reject the SVC panel recommended to him by the panel comprising the State Chief Minister, Deputy Chief Minister, Law and Parliamentary Affairs Minister and the Leader of the Opposition in the State Assembly.
The recommendations had run into rough weather after the Governor raised queries about the nomination of the former State DGP, Kuldeep Khoda as the SVC chairperson and a senior retired bureaucrat, R.K. Jerath as one of the two members of the SVC.
The Governor's query pertained to the recommendation of the former DGP's name as the head of the SVC even when the State High Court was hearing a case of a fake encounter in which Khoda's name had been mentioned. Besides, Leader of the Opposition in the State Assembly, Mehbooba Mufti had expressed serious reservations over the suitability of the former DGP's nomination to the high profile SVC.
The leader of the opposition had placed a missive on record during the recommending panel's meeting which had also been forwarded to the Governor along with the final recommendations.
Sources in the State secretariat have now told ET that instead of reframing its recommendations the State government has now decided to address the queries raised over the panel's recommendations by Raj Bhavan.
Previous reports had mentioned that the State Government had decided to recommend a fresh panel for the SVC after its earlier recommendations had hit the roadblock at the Raj Bhavan. Those reports also suggested that the name of a retired State Chief Secretary, S.S. Kapur was being recommended in replacement of the former DGP's name as the head of the SVC.
Highly placed sources have told ET that the recommendations from the General Administration Department and the Law Department to push for the earlier recommended panel are now pending with the State Chief Minister who is likely to take the final call on this highly sensitive issue within a day or so. Whether the Chief Minister sticks to his previous stand with regard to the SVC nominations or decides to recast the recommendations would go a long way in determining the seriousness of the State Government in tackling the scourge of corruption in Jammu and Kashmir.
