DB issued notice in CMP Seeking modification order of No entry and no parking at Ragunath Bazaar

Jammu, February 07, 2007
Division Bench of J&K High Court Jammu wing comprising Chief Justice BA Khan and Justice JP Singh today in a CMP filed by President and General Secretary to Ragunath Bazaar Businessmen Association Jammu seeking modification of the order dated December 28, 2006 passed in the much publicized Public Interest Litigation for Regulation of Traffic in J&K in which the Division Bench stop entry of all types of vehicles into Ragunath Bazaar from Residency Road, City Chowk, Hari-Market and Gurudwara Sunder Singh Road from February 1, 2007, issued notice to Court counsel and Additional Advocate General for the state with the observed that the association to project their view point before the Traffic Authority regarding the issue.



In the petition filed through Advocate Ashok Parihar in which it has been submitted that the order dated December 28, 2006 in so far as it relates to declaring Ragunath Bazaar Jammu as NO Entry and No-Parking area which has been made effective from February 1, 2007 has adversely affected not only the general public but the businessmen, traders as well as the local residents of adjoining Mohallas, which has caused extreme hardship and inconvenience to them as their business has been considerably effected and they are running in losses because no people who came for shopping or allowed to enter and parked their vehicles because of inadequate parking space in the nearby parking lots.



It is further submitted that while passing the aforesaid directions, the petitioner association has not been put on notice nor heard in the matter and as such they have been deprived of presenting their case and making suggestions before the Court, so as to ensure that the traffic is also regulated and at the same time the shopkeepers as well as the general public and local residents of the area also do not suffer inconvenience and loss of business. In the prayer the petitioners prayed before the Court seeking modification of the order dated December 28, 2006 and also prayed that pending the final disposal of this CMP order dated December 28, 2006 in so far as it bans the entry and parking of vehicles may kindly be stayed and allowed the traffic to enter the bazaar, so was the position prior to February 1, 2007.
