| HC directs CS, RG JK High Court to file reply | | PIL for State Bar Council | | early times report
Jammu, Sept 5 (JNF): In a Public Interest Litigation filed by two lawyers Vishal Mahajan and Manav Sanmotra seeking constitution of State Bar Council under Advocates Act, 1961, Division Bench of the State High Court comprising First Puisne Judge Justice Virender Singh and Justice Muzaffar Hussain Attar after hearing Senior Advocate Sunil Sethi assisted by Advocate Sumit Singh, issued notice to the Chief Secretary J&K State and Registrar General J&K High Court which were accepted by Sr. AAG Gagan Basotra for the State and Advocate Aditya Gupta for the High Court respectively.
In view of the completion of service, Division Bench directed both the respondents to file their response within four weeks with advance copy to Advocate Sumit Singh. The court in view of the importance of the issue directed the Registry to list this PIL in the week commencing October 8, 2012.
In the PIL it has been submitted that the all the states have their State Bar Councils headed by the Elected Body of Advocates of their respective states, however, in State of J&K, the High Court is exercising the powers of State Bar Council under section 58 of the Advocates Act, 1961 with effect from January 31, 1974.
The petitioners also had prayed that the State Bar Council be constituted in terms of Advocates Act 1961. |
