Rape, murder of deaf & dumb girl

Jammu, Sept 6 (JNF) : In an alleged rape and murder of deaf and dumb girl, Justice Muzaffar Hussain Attar of J&K High Court Jammu Wing has directed Director General of Police to inform the Court by filling an affidavit as to what action has been taken against  delinquent officials in terms of the Court order dated April 25, 2012 (whereby Court said that the local police and the functionaries of the hospital had been negligent in conducting investigation and preserving the vitals of the deceased for expert opinion. Thereon requisite action is warranted against all those who have been remiss and negligent in the performance of their official duty). Justice Muzaffar Hussain Attar after hearing Advocate Shah Mohammad Choudhary appearing for the petitioners whereas  AAG Gagan Basotra appearing for the state observed that Special Investigating Team Constituted by the Court has filed status report in a sealed cover. Sealed Cover is open in the Court, perusal of the status report filed by Deputy Inspector General of Police H/R Range Udhampur revealed that one Baldev S/o Kanshi Ram has been taken into custody for questioning. Report also shows that he is prime suspect for commission of the offence. Upon this Court directed Registry to keep the report in a sealed cover and list this case in the week commencing from October 2, 2012. Court also directed SIT shall file latest status report about the progress made in the investigation of the case by next date. This direction has been passed in a petition filed by the father father of the deceased girl whose dead body was recovered from dry well and the matter being reported to the police, the cause of her death was indicated as poisoning by ALUMINIUM PHOSPHIDE. Her post-mortem examination further revealed that she was carrying foetus of 14-16 weeks at the time of her death. Upon this proceedings u/s 174 CrPC were initiated by the Ram Garh Police Station. Dissatisfied with the manner the police was conducting the inquest proceedings, the father of the deceased approached the Chief Minister seeking proper investigation so that those responsible for the rape and murder of his deaf and dumb daughter were arrested and proceeded against under law. On this basis of the findings recorded in proceedings u/s 174 CrPC, FIR was registered at P/S Ram Garh on January 6, 2010 u/s 302/376 RPC. Complaining that the police was not serious in the investigation of the Crime, the father of deceased has approached the High Court seeking constitution of a SIT for the investigation of the FIR. During the currency of the proceedings in the petition, the SSP Crime Branch Jammu filed status report which records that the local police had conducted proceedings u/s 174 CrPC in a most casual and unprofessional manner, because of the negligence of the police, important available evidence is stated to have been lost.
