Dr Waseem to meet Guru’s fate.....? | | | First anniversary of Delhi High Court blast case
Asif Iqbal Naik KISHTWAR, Sept 6: On the first anniversary of the Delhi High Court blast which left several persons dead and scores wounded, the object of the blast remains unfulfilled. In fact, death looms large on Afzal Guru and Dr Wasim, the prime accused in the blast is another Guru in making. Afzal Guru sentence was schedule to be carried out on August 20, 2006, but President of India stayed the sentence after his family members filed a celemency petition. Dr. Waseem Akram Malik presently lodged in Delhi jail will be facing charges under Unlawful Activities Act, murder, criminal conspiracy, and waging war against the country, attempt to murder and Explosive Act for his alleged role in the blast case. The charges if proved will win Waseem nothing less than death penalty. As per the National Investigating Agency (NIA), they have sufficient proofs against Dr. Waseem Malik. The NIA is hopeful of getting Waseem convicted. The decision of framing charges against Dr. Waseem Malik and his associates comes merely three days before the first anniversary of Delhi High Court blast. NIA during its first six months of investigation had filed charge sheets against six including three arrested accused viz Dr. Waseem Akram Malik, Amir Abbas Dev and Abid Hussain Bhawani (Presently on bail) and three absconders Chota Hafiz, Amir Ali Kamal (now dead) and Juniad Akram Malik (whereabouts not known) all said to be the members of HM militant outfit active in Jammu and Kashmir. Among the two arrested accused, Amir Abbas Dev presently in judicial custody has turned approver for the NIA, which means that he (Amir Abbas Dev) will testify his statement in favour of NIA and against Dr. Waseem Akram Malik. As per the prosecution, Dr. Waseem Malik handed over the written test for the email sent from Global Internet Cafe Kishtwar claiming the responsibility of blast outside Delhi High Court merely few hours after the blast was carried outside the High Court. An email which is said to be written by Dr. Waseem Akram Malik and his associates claims the responsibility of the Delhi High Court blast with an aim to get the death sentence of Parliament attack case convict Afzal Guru commuted to life imprisonment. Another accused, a teenager Abid Hussain Bhawani who had allegedly send the email to media house claiming blast outside Delhi High Court also gives his statement in the court in favour of NIA which further substantiate the NIA charge sheet filed against Dr. Waseem Akram Malik. NIA in its charge sheet also named two Pakistani Bilal Bahi and Saifullah for their alleged involvement in the blast case who are still at large. Going back a year ago, it was 1.30 AM on the morning of September 8, 2011, when I got a call from my fellow colleague from Jammu intimating me that the email claiming the responsibility of the blast outside Delhi High Court was sent from a cyber cafe in Kishtwar district. As on one side, my colleagues are inquiring about the cyber cafes in Kishtwar district and on the other hand I am feeling nervous. I started dialing the mobile numbers of police officials, but no one was responding to my repeated calls. I am in dilemma weather to call one of my friend owing cyber cafe in Kishtwar, but hesitated in doing so, but luckily I got a call from my friend owing cyber cafe in Kishtwar. I picked up the mobile and my friend who informed me that it was global internet cafe which was used by some unidentified persons for sending an email claiming responsibility of blast outside Delhi High Court. After knowing about the involvement of Global Internet cafe owned by the brother of my friend, I was more shocked as I have seen the emerging of the owner of the Global Internet cafe as more professional in handling such things as compared to my other friend who also owned a cyber cafe in Kishtwar district. The focus of the media suddenly shifted towards Kishtwar district followed by 24 hour nonstop coverage from electronic and print media. As the investigation moves ahead under the supervision of the then DIG Doda-Kishtwar range M.K Sinha, the curtains starts coming down with the passage of time, NIA and Kishtwar police achieved a major breakthrough on 10-9-2011 with the detention of two teenagers Abid Hussain Bhawani and Sharik Khawar Butt followed by the arrest of another teenager Amir Abbas Dev. Finally the police during its investigation gave clean chit to Sharik Khawar Butt for his non involvement in email sending case and shifted both Abid Hussain Bhawani and Amir Abbas Dev to Delhi and book the both of them for their alleged role in helping the Delhi High Court blast accuse and for having a willful knowledge about the blast in advance. After getting hands on the main accused involved in sending email claiming responsibility of the blast sent to the various media houses, the NIA managed to break the password of the email addressed created at 1.02 PM on September 7, 2011 and subsequently sent the typed email, which the accused carried along with himself written on a paper. The investigation further reveals that the culprit emailed the drafted email to media house at around 1.16 PM from terminal 3 of the cyber cafe, which was received by the media house showing the time difference of two minutes. After surfacing the name of Abid Hussain Bhawani and Amir Abbas Dev, the focus shifted on the arrest of the main culprit named as "Doctor". As per the investigation "Doctor" was the main culprit behind the Delhi High Court blast and both Amir Abbas Dev and Abid Hussain Bhawani have little knowledge about him and the service of sketch experts comes handy to the investigating agencies. The sketch expert starts making sketches of "Doctor" as per the description given by the two arrested youths. Once the sketch of the main accused gets ready, the same was passed to Kishtwar police by the NIA and it was one of the official of Kishtwar police who recognized the sketch as that of Dr. Waseem Akram Malik, the brother of Juniad Akram Malik who according to the family was kidnapped by the HM militants with the help of Azhar Ali Butt of Padder tehsil of Kishtwar district lodged in Kotbalwal jail in Jammu at that time serving the PSA detention. The identification of the sketch by one of the official of Kishtwar police helps the investigation in moving forward as NIA without wasting any time procured the permission from Additional District Magistrate Kishtwar for meeting with Azhar Ali Butt lodged inside jail. It was Azhar Ali Butt who informed the NIA and Kishtwar police regarding the activities of Dr. Waseem Akram Malik in Bangladesh. After questioning Azhar Ali inside Kotbalwal jail, NIA and Kishtwar police started monitoring the mobile phone of Dr. Waseem and finally manage to arrest him from Indira Gandhi International Airport New Delhi after he was called in by the family from Bangladesh. As per NIA, Dr. Waseem Akram Malik was known to Abid and Amir Abbas as Doctor Sahib held a meeting at a house near Degree College Kishtwar which was attended by Juniad Akram Malik, younger brother of Dr. Waseem Malik whom Kishtwar police declared as an active HM militant, beside by Amir Abbas Dev and few foreigners including Saifullah and Bilal Bahi said to be Pakistani and Bangladeshi nationalists and framed the strategy regarding the final outlay plan of executing the blast. As per NIA, the accused Dr. Waseem along with two foreigners left Kishtwar on 6-7-2011 and executed the blast in a well hatched conspiracy leaving 16 people dead and injury to 79 others. The investigation carried out by the NIA suggested that the Delhi High Court blast is the handiwork of multiple organizations viz Hizbul Mujahideen, Harkat-Ul-Jehadi-Islami and Indian Mujahideen and the planning has been executed in Kishtwar district way before the blast was carried out. NIA in its investigation finds that in a well coordinated plan HM provides the explosive material for carrying out the blast, where as HUJI and IM transferred the explosive material to Delhi and carried out the blast and later manage to flee from the capital with the active help of the members from sleeper cells of the terror outfits. NIA feels that with the arrest of Saifullah and Bilal Bahi and Chota Hafiz will provide more vital information about the perpetrators involved in last year September 7 blast. The arrest of all the absconders will also help the investigating agencies to track down the sleeper cells of various militant outfits active in capital and its adjoining areas. Though the family members of Dr. Waseem Akram Malik and Amir Abbas Dev claim that their children's are innocent and have been framed in false case, but the NIA said that every family has the right to claim the innocence of their children's and said that NIA has sufficient probe for conviction of all the arrested accused. NIA officials said that law will take its own course and it was up to the court to examine the proofs submitted by the investigating agency and deliver its judgment on the bases of the facts presented before the court. |
