Notices to SSP, SDPO, SHO for not complying with court directions

Jammu, Sept 7: High Court of Jammu & Kashmir today issued notices to SSP Jammu Prabhat Singh and other police officials for not complying with the court directions regarding illegal interference and forcibly evicting the Petitioner Kaku Ram S/o Ram Chand R/o Village Dinga Amb, Hiranagar, District Kathua, a legal and lawful owner in possession of Land measuring 12 Kanals under Khasra No. 2195 ,2196, Khewat No. 15 , Khatta No. 397 situated at Sunjwan, Tehsil and District Jammu.
In the interim order dated 30-8-2012, Division Bench of High court has directed the respondents not to interfere in any manner with petitioners possession in the land which is subject matter of dispute till the next date of hearing.
But respondents despite clear court direction started constructing the police post on the said land by using the State machinery and misuse of power.
The grieved Petitioner Kaku Ram again approached the Hon'ble High Court for restraining the Police Department to forcibly dispose off him from the land in question.
Again in its interim order dated 4-9-2012 court has ordered for report of Compliance of its interim direction dated 30-8-2012 and issued notices to SSP Jammu Prabhat Singh, SDPO Narwal S.S Sambyal, SHO Channi Himmat Deepak Pathania and Incharge Police Post Sainik Colony Naresh Sharma.
In its writ petition the petitioner Kaku Ram has submitted that the respondents who are the officials of Police Department are bent upon to forcibly dispossess him from the aforesaid land and to install a police post on the said land.
The land covered under the aforesaid sale deeds is vested in him validly and legally and that he has every right to own, possess and occupy the same and that he cannot be evicted from the said land without following the procedure established by the law.
The respondents are acting arbitrary and malafide manner with intent to dispossess him from the said land.
The petitioner has no other option but to approach this Hon'ble Court for the redressal of his grievances.
