Bail granted to two alleged militants, denied to Pak Woman
Police fails to file challan within 180 days

Jammu, Sept 10 (JNF) : Principal District & Sessions Judge Jammu Jang Bhadur Singh Jamwal today granted bail to Sheeraj Ahmed S/O Mohd Abdullah R/O Dharpura, Shopian and Ghulam Ali S/O Ghulam Qadir R/O Khari, Banihal District Ramban who were booked by P/S Chand erkot U/Ss17/18/19/20/21 Unlawful Activities, 2/3 EIMCO, 3 EAO, 3(3) PP Act, 14 FA & 120-B/109 RPC in FIR NO 9/2009 and rejected bail application of accused Faiza D/O Hyder Zaman resident of Shanja, Rawalpindi, Pakistan who was remanded to Judicial Custody for the period of ten days from today. While allowing the bail application of two accused, Principal Sessions Judge Jammu Jang Bahadur Singh Jamwal after hearing Advocates AK Chatta appearing for accused Sheeraz Ahmed and Fiaza Choudhary and Advocates Sheikh Zulfikar Ahmed, Kabir Malik and Zulkar Nain appearing for accused Ghulam Ali observed that that it is revealed from the remand order dated Sept 7, 2012 that the accused are entitled to bail because challan has not been filed against them within prescribed period of time, yet the accused were remanded to judicial custody or till they furnishes bail bonds etc. which ever is earlier. According to police case that during investigation ,on March 11, 2012, DySP (Operations), Gool received information that two militants namely, Ghulam Ali Code Muzamil and Sheeraz Ahmed alias Shakir had cross the LoC in the year 2000 without permit for training of subversion and handling of arms ammunition in PoK and are returning back India after training through Nepal without permission and are on journey towards J&K.
The police proceeded to Jammu and arrested both the aforesaid accused from Railway Station, Jammu. The accused Faiza Begum, who was a Pakistani lady, reportedly wife of accused Sheeraz Ahmed along with minor children was also accompanying both the aforesaid accused. She was also arrested as she entered in India illegally without any passport. During interrogation of the accused, it revealed that the accused Ghulam Ali had joined Hijbul-Mujahidin (HM) outfit in Banihal area and crossed LoC in the year 2000 and obtained subversive training in PoK and recently was sent back to J&K by ISI for subversive activities in Ramban.
The investigation finally proved the offences U/Ss 17/18/19/20/21 Unlawful Activities Act, 2/3 EIMCO, 3 EAO, 3(3) PP Act & 120-B/109 RPC against the accused Sheeraz Ahmed and Ghulam Ali and offence u/s 14 Foreign Act was established against the accused Faiza Begum. Three minor children were handed over to one Mohd Abdullah by the order of Judicial Magistrate First Class, Batote for their safe custody.
