| DB imposes cost against police officials in illegal confinement case | | | Jammu, Feb 09 In another case of Police atrocities, the Division Bench of J&K High Court Jammu wing, comprising Chief Justice BA Khan and Justice Hakim Imtiyaz Hussain, in an appeal filed against the judgment of single judge dated March 16, 2000, directed the respondents to complete the enquiry and submit the report subject to further costs of Rs 5000/- to be paid by SP Ramban to the appellant Gurcharan Singh to meet his litigation expenses. The DB ordered that the respondents shall execute personal bond to the satisfaction of Registrar Judicial and also deposit cash security and ensure their appearance before the Court on next date of hearing. This significant Court direction has been passed in a LPA filed by Gurcharan Singh against order dated March 16, 2000 passed by the Single Judge whereby the petition of the appellant was dismissed. The appellant in LPA submitted that he loaded his truck with fruit from Srinagar to Ahmedabad and when he entered within the jurisdiction of Police Station Batote on the intervening night 25-26 January1997, a police party near Nashri By-Pass stopped his truck. The Police party demanded Rs 50 as entry fee, which the appellant refused to pay. On refusal, he was attacked by the police party as a result of which his right arm was broken and thereafter he was taken to police station and kept in lock-up and manipulated a false case against him u/s 279 RPC. The appellant highlighted the atrocities committed by the police concerned and sought registration of case against the concerned officials and compensation for his illegal confinement and torture at the hands of the said police officials.
