| HC issues notice on suspension of K. Oil licenses | | | Jammu, Feb 09 In a writ petition filed by President Kerosene Oil Retailers Association Jammu and Others challenging the suspension of all kerosene oil licenses within Jammu Municipal area, Justice Nirmal Singh of J&K High Court Jammu wing issued notice to State of J&K through Commissioner/Secretary CAPD, Additional secretary CAPD and Director CAPD Jammu for filling objections within two weeks. According to the petition, the petitioners are licensees and are authorized to supply and store kerosene oil for a period of one year, which is renewed every year and presently their licenses are renewed up to March 31, 2007. The licenses issued to most of the members of the association are more than 15 years old and is being renewed regularly having nothing adverse against them. According to the petitioners, Additional Secretary to Government CAPD Department vide order dated January 27, 2007 suspended en-masse all kerosene oil licensees within the Jammu Municipal area for a period of one month with immediate effect in violation of principle of natural justice without affording any opportunity to the petitioners of being heard and discriminating with petitioners in a very unreasonable, unjustified and arbitrary manner without holding any enquiry. The petitioners prayed before the Court for quashing the order dated January 27, 2007 issued by respondent Additional Secretary CAPD Department.
