Court acquits accused involved in illicit trade of charas

Second Additional Sessions Judge Jammu Mr. AK Koul today acquitted Ghulam Nabi Bhat of Anantnag presently at Qasim Nagar Jammu from the charges of indulging in illicit trade of charas.
According to the case, the Bagh-e-Bahu police while on routine patrol towards Qasim Nagar Jammu, a source report was received that accused Ghulam Nabi Bhat s/o Ghulam Ahmed Bhat was indulging in illicit trade of charas. The police officer sent a message to SDPO City East and team was sent to apprehend the accused.. During the search, 29 cobs of charas were recovered from a polythene bag from his possession. The contraband recovered was one kilogram and four hundred grams. After the completion of the investigation, challan was presented in the Court of law on May 4, 2006. Court decided the case with less than a year.
In the acquittal judgment Mr. Koul, after hearing Additional Public Prosecutor for the State and Advocate Manohar Lal appearing for the accused and also considering the case along with the statements of the witnesses, observed that the Court is of the considered view that there were so many missing links in this case. The prosecution has not been able to connect the accused with the guilt as required under the law. The evidence oral and documentary does not prove the guilt of the accused beyond any shadow of doubt. Thus, the Court has no option but to hold accused innocent. The case is accordingly dismissed and the accused is acquitted from the charges leveled against him. JNF
