Jammu, June 17: Even after 44-years Jammu and Kashmir government has failed to clear the pending dues of M/S Bishamber Dass Rabinder Nath Anand contractors, who established Jhelum Hydel power project in north Kashmir's Baramulla district in 1973 and 1974

has written a letter to Dr Shah Faesal, Managing Director of JKSPDC, to intervene to get the earnest money, security deposit, performance guarantee bond and balance payments released.
In her letter to Shah Faesel, Mehak has stated that her late father and grand-father floated a contractors firm by the name of M/S Bishamber Dass Rabinder Nath Anand, Contractors. "My grand-father expired in 1980 and consequently my father expired in 2004 leaving me and my sister as their legal heirs. We have been facing very tough times to make our ends meet since then."
She states that recently she came across certain contract documents and legal notices pertaining to various works allocated to M/S Bishamber Dass Rabinder Nath Anand, Contractors firm vide various allotment letters and agreements executed in the years 1973-74. "M/S Bishamber Dass Rabinder Nath Anand, Contractors firm was a reputed firm and they had executed many difficult and treacherous works in Lower Jhelum Hydel Project to the full satisfaction of the department", said Mehak adding that the firm was very competent and resourceful that is evident from the reference letters issued by various offices.
"Unfortunately while executing the tender for 'Construction of Escape and Its Outfall Channel AT RD 13165-75 of Lower Jhelum Hydel Project', the firm was forced into financial constraint by the then Chief Engineer, LJHP and the firm fell on bad times and my grand-father expired due to the cash crunch created deliberately by the department by withholding bills and payments which were due during the execution of the above mentioned tenders", said Mehak adding that the indifferent attitude of the JKPSDC led to the entire family being pushed to wall. "We had no money even to meet our daily expenses," she writes.
She states that her father Late Rabinder Nath Anand died due to poor financial condition in 2004 as the officials didn't release the payments. "Till his last day he was hopeful that payment will come but it never came," she writes.
"As a student with limited resources and bleak knowledge of business related affairs I was not able to understand the nature of documents left behind by my late father and grandfather," Mehak states.
She stated that recently she came across certain letters referring to release of security deposit, earnest money, performance guarantee bond and final bills along with interest accrued on them till date along with balance payments pertaining to the various works done by the firm and for extra items for the above mentioned tenders as well as for other works executed and finalized are still pending with the then DFA & CAO, now Chief Pay and Accounts Office, Lower Jhelum Hydel Project, Baramulla, J&K State.
She maintained that also machinery advance issued in favour of the contractor was liquidated in full by them at that time but the machinery is still in the possession of the department for unknown reasons. Therefore, the machinery which included stone crusher, concrete mixtures, vibrators, de-watering pumps etc should be released in my favour since the same pertains to the office of the then DFA & CAO, now Chief Pay and Accounts Office, Lower Jhelum Hydel Project, Baramulla, J&K State.
"I had approached the office of the Managing Director JKSPDC in connection with this matter in 2012 and now once again I am approaching concerned officers for their kind intervention. I request your goodself to instruct then DFA & CAO, now Chief Pay and Accounts Office, Lower Jhelum Hydel Project, Baramulla to release the above mentioned amounts and payments along with interest accrued till date due in favour of the firm M/S Bishamber Dass Rabinder Nath Anand", said Mehak.
She states that the balance payment including the final bill c.c 13 in original along with its M.Book amounting to lakhs related to various works executed and finalized by my late father is still pending with the office of then DFA & CAO since 1973-74.
