| Div Com's report establishes tampering of Revenue record | | PIL regarding alleged hushing up of Chatta-Sunjwan land scam | | Jammu, Apr 22 : In the much publicized Public Interest Litigation against alleged hushing-up of Chatta-Sunjwan land scam, A Division Bench of State High Court Comprising Chief Justice N Paul Vasanthakumar and Justice Dhiraj Singh Thakur impleaded then Naib Tehsildar Choudhary Aslam Din, then Patwari Halqa Sunjwan Mohd Iqbal Zargar and then Additional Patwari Sunjwan Mohan Singh as party respondent in the PIL and directed the Registry to carry out the necessary corrections in the cause title of the case.
In the three Miscellaneous petitions then Naib Tehsildar Choudhary Aslam Din and the two Patwaries have submitted that questions have been raised about the two sale deeds of the land falling in Khasra No 1442 executed in the year 2004 and 2005 for which the fards were prepared by the Patwari concerned and attested by the applicant Choudhary Aslam Din but the fards had been questioned without reference to the revenue record. As the per the Girdwari of the land recorded with effect from RABI 1955 the land falling in Khasra No 1442 has been recorded as proprietary land in the name of Udham Singh & Ors, co-sharer owners. The applicants have further submitted that without affording any opportunity of being heard the report has been placed alleging encroachment of the state land measuring 20 Kanals 12 Marlas falling in Khasra No 1442 of Village Chattha-Sunjwan.
It is worthwhile to mention herein Shantmanu then Divisional Commissioner Jammu submitted an enquiry report on the last of date of hearing in which the Divisional Commissioner confirmed that Khasra No 1442 is actually a state land and has not been transferred in accordance with the rules and inspite of the state land has been put to fail by apparent tempering with the record and laterally inserting under the category of private land and thereafter fard and mutations No 225-J and 312-J of the same have been prepared/issued and attested by the then Patwaries and Naib Tehsildars concerned. Shantmanu while concluding his report further said that prima-facie tempering has been done in revenue record and detailed investigation for specific issue of tempering of revenue record i.e. is the jamabandi for the year 1998-99 BK of village of Sunjwan is required. Deputy Commissioner Jammu has forwarded the names of revenue officers/officials working in the area during the period under consideration. However, persons responsible for insertion/tempering can only be ascertained after proper investigation. Needless to mention herein the Govt of J&K earlier had appointed Sudhanshu Pandey IAS then Divisional Commissioner Vide Govt Order NO 05-GAD of 2008 dated January 1, 2008 to enquire into the Chattha-Sunjwan Land Scam, but Sudhanshu Pandey could not finalized the inquiry and thereafter on the directions of Division Bench, the Govt issued Govt Order No 1083-GAD dated October 20, 2014 appointing Shantmanu then Divisional Commissioner to conduct the inquiry and submit a report to the Govt.The Divisional Commissioner submitted a detailed report wherein it was confirmed that State land measuring 20 Kanals and 12 Marlas comprised in Khasra NO 1442 situated at Sunjwan was illegal sold by tempering with the revenue record and the inquiry officer recommended detailed investigation in the matter.
