DB disposes of case lying lingered since 1987

Srinagar, Sept 24: A Division Bench of the State High Court comprising Chief Justice N Paul Vasathakumar and Justice Hasnain Massodi in a significant decision today has disposed of an appeal in matter which had seen prolonged legal battle over two decades i.e. since 1987 including twice before the Apex Court.
The appeal was filed against an order dated 11 September 2011, the case involving payment of benefits to an employee by National Project Construction Corporation (NPCC) has witnessed a prolonged legal battle with the matter even going to Apex Court on two occasions.
"In such circumstances, this appeal is disposed of by consent of parties to pay a sum of Rs. 10.00 lakhs as full and final settlement," the Division Bench of the court said. "For handing over the Demand Draft to (petitioner Bali) by the respondent NPCC post on 14 October," the Division Bench added.
In fact, the high court also had suggested counsel for the appellant (NPCC) as well as the employee to settle the case amicably. Pertinently, on 16 September, the court had asked the employee, one Mashoor Singh Bali whether case be settled and NPCC was asked to pay a sum of Rs. 10 lakhs as a full and final settlement of the matter. The employee who was present in the Court, agreed to receive a sum of Rs 10 lakhs while counsel for NPCC sought time to get instructions about the proposal suggested by the court. Project Manager, NPCC Ltd. who was present in the Court, submitted that the Corporation is willing to pay a sum of Rs. 10 lakhs as full and final settlement and two weeks' time be given to get the Demand Draft of the amount.
