DSP holds Jt Secy post in JKCA in violation of Service Rules

Jammu, May 9: A serving Deputy Superintendent of Police allegedly held the position of Joint Secretary in J&K Cricket Association (JKCA) without obtaining mandatory No Objection Certificate (NOC) from his department, in brazen violation of the JK Service Rules and Regulations Act. Moreover, during his tenure as Joint Secretary, the cop withdrew two salaries-one from his parent department and other from JKCA.
The documents available with Early Times revealed that not only did he get position in JKCA illegally but was also found involved in misappropriation of funds in various cases by the auditor in its report.
Sudershan Mehta, presently posted as DSP, SDRF 2nd Bn. Jammu, was actively involved into the business of JKCA affairs, which is a private body and held important portfolio in JKCA as the Joint Secretary for year 2003-2006. The same post was held by him again in 2009, and then in 2014-2016, during which he had drawn salaries against his name and also TA, DA and other allowances in violation of the rule 10 of the J&K Service Rules and Regulations Act by not obtaining NOCs as required.
The documents revealed DSP Mehta had applied for the post facto permission from Directorate of Homeguard Civil Defence and SDRF J&K-Jammu w.e.f. 12-05-2014 under SRO-164 of 1980 dated 27-03-1980 for holding office bearer of JKCA, which was forwarded by this Directorate to PHQ J&K.
Interestingly, PHQ vide letter No. Gz/P-Case/S-97/DYSP/2015 dated 01-08-2015 has intimated that as per SRO-164 dated 27-05-1980 there is no provision for the post facto sanction, only prior permission is required for the purpose. Therefore the request of the officer was rejected. The officer again applied for the permission to the Directorate which was again rejected.
The documents further revealed that DSP Mehta attended the office of JKCA on all working days and obtained salary and allowances in different forms. Astonishingly, he also showed and marked his presence in attendance for government job and withdrew salary defrauding the government. Not stopping here, the cop allegedly misused the funds of JKCA and has defrauded the Association. He allegedly altered, mutilated, falsified the accounts and furnished false bills for his personal motive, which the auditor report appointed by JKCA has revealed.
The findings of the audit reports revealed that DSP Mehta always ignored the Vice Chairman and took most of the decision unilaterally without seeking opinion from Vice Chairman. Payment of Rs 67,600 was made to M/S Meals Jammu on account of supply of refreshment to the players on various days as per his cash memo 1519 & 1520 dated 24-05-2009. As the purchase committee was formed on 05-05-2009 and decision for supply of refreshment was taken on 06-05-2009 but the quotations were obtained before the formation of purchase committee on 04-05-2009 and 05-05-2009, which is also contradictory and misleading.
Payment of fee of Rs 9500 and Rs 7500 paid to the observers Sandeep Gupta and Vinay Sharma. While making verbal enquiries, he came to fore that Sandeep Gupta is a non-cricketer and has been engaged as observers just to pave way to please him by offering a handsome amount for no work done by him.
It was observed that no observation report was submitted by the either of the two observers. Payment of Rs 3600 made to a Raj Kumar Driver of Qualis vehicle No. 0055 on account of taxi fare from Jammu to Rajouri and back to Jammu on 29-06-2009 was wrongly debited to telephone expenses head instead of transport expenses head.
