GMCH defies court order, purchases items from particular firm

Jammu, June 11: Defying court's stay order on not purchasing items from a particular company, the management of the Government Medical College and Hospital Jammu has been allegedly purchasing items from the said company without completing codal formalities.
Moreover, in-spite of request that Purchase Committee of the GMC Jammu should be involved as it is financial matter, the purchase is continuing.
The court had ordered a stay (under OWP no. 1861/2014 & CMA no. 2403/2014) on Abbott Biochemistry and Immunoassay Analyzer in GMC and its associated hospitals. "But in spite of the stay order, the management of the hospital is still purchasing items," says a May 22 letter from the AAR ENN BEE Medical Solutions to the Principal of the GMC Jammu.
In the letter it was alleged that the hospital is still purchasing the items from the mentioned company despite rate contract stayed by High Court, and no action has been taken so far.
It further states that another letter has been sent to Medical Superintendent, GMC Jammu stating that the office has received two proposals from two different firms (Spectrum Medical Industries PVT. LTD and Abbott Health Care Pvt. LTD) duly endorsed by Principal GMC Jammu vide receipt no. 1473 dated 4-5-2018 and from your office vide no MCH/PS/2021-23 dated 21-5-2018 regarding the subject cited above. Another proposal has been received by this office directly from Ortho Clinical Diagnostic. Thus the matter may be taken up with the purchase committee GMC Jammu under rules for favour of further necessary action.
Earlier, State Rate Contract Committee No. 1, GMC Srinagar, dated 8-7-2013, had approved rate contract of 25 items in favour of the Abbott Health Care Pvt. LTD. But later on 28-4-2014, 39 more items had been incorporated in vide no. RCC/RC-RR/2014-15/235-42, without completely codal formalities reportedly.
Sources informed that the Purchase Committee had not given permission to Super Specialty Hospital Jammu but machines were installed in the hospital. The Committee had only given permission to Shree Maharaja Gulab Singh hospital to procurement items from the above said company.
Since the inception of Jammu and Kashmir Medical Supplies Corporation Limited, management of the respective hospitals cannot procure any equipment and other items. But the GMC management is still purchasing items without taking NOC from concerned authority.
