JAC prays Gurezi to abrogate Article 370
6/15/2018 10:50:54 PM
JAMMU, June 15: Joint Action Committee J&K and JKGCWF today held an emergency meeting at Brahaman Sabha Jammu today in the context of the reservation in promotions under the chairmanship of Ved Prakash Sharma, president Brahman Sabha
Ved Prakash Sharma informed the gathering about the breach of oath of constitution by Nazir Gurezi as Dy. Speaker of the legislative assembly as he has formed an unholy consortium of MLAs based on caste lines and repeatedly called up their meetings in his capacity as Dy. Speaker of the house vide his letter no.ps/ds/la/k/254-75 dated 13/6/2018 and tried to create undue influence on the hon'ble chief minister for allowing the reservation in promotions.
The Dy Speaker has forgot the constitutional position being held by him and his approach of taking partisan lines speaks volumes about the hatred being spread by him against the general masses. The Dy. Speaker has gone ahead and away from party ideology and is advocating for abrogation of article 370 in order to restore reservation in promotions in state of J&K. "Nazir Gurezi has maligned the sanctity and respect of the chair held by him, as well as disrespected the sovereignty of Constitution of Jammu and Kashmir which is guaranteed under the Constitution of India and upheld in various judgments of Supreme Court.
Narayan Singh president Amar Khastriya Rajput Sabha informed that High Court of Jammu and Kashmir in its landmark judgment dated 9.10.2015 in the case titled Ashok Kumar Sharma vs State of J&K had quashed the reservation in promotion rules. The judgment has been delivered based on the two premises. One was that 77th amendment of Constitution of India was not extended to the state of Jammu and Kashmir and accordingly article 16(4) which grants reservation in promotion does not get directly implemented in the state of Jammu And Kashmir. Secondly as per the supreme court judgment in case of Nagraj Vs Uoi of 2006, it was held that states can grant reservation in promotions only if it satisfies the two criteria:
