SIC slaps penalty notice on XEn R&B Sumbal

Srinagar, Dec 7: State information commission has slapped penalty notice on Executive Engineer (XEn) PWD (R&B) division Sumbal in Badipora for disregarding itsorder and violating the provisions of J&K RTI Act. The Commission has directed the officer to submit his written statement before it within 2 weeks. According to detail available with ET, an application dated 25.03.2018 filed by one Sajad Ahmad Bahar a resident of Sumbal Sonwari had sought information on 10 points from Public Information Officer PIO/Executive Engineer, R&B Circle, Sumbal Sonawari. In response to the said RTI request, the PIO/Executive Engineer vide his communicated dated 04.05.2018 informed the appellant that factual report about the RTI request has been submitted to Superintending Engineer, PWD (R&B) Circle Ganderbal/Bandipora and therefore there was no need to give any further comments.
Subsequently the information seeker filed 2nd appeal before the State Information Commission (SIC) on 02.08.2018 praying for a direction to the PIO to furnish information and also for penalizing the PIO. SIC in its order ruled, "The continued absence of the PIO during the hearings held by the Commission in this appeal demonstrates the causal and non-serious approach of the PIO towards the J&K RTI Act and also the directions issued by the SIC. Accordingly, the registry is directed to issue a show cause notice upon the PIO/Executive Engineer, R&B Circle, Sumbal Sonawari directing him to explain as to why penalty as envisaged under Section-17 of the J&K RTI Act shall not be imposed upon him on account of his failure to provide information to the appellant within the specified period".
The SIC further directed that the PIO shall be directed to submit his reply to the show cause notice within a period of 15 days from the date of issuance of notice and shall be specially informed that in case no reply is received within the aforesaid period, the penalty proceedings shall be held exparty against him.
