DB observed that in his status report Chief Engineer, PWD (R&B) had stated that no parapet of the bridge has been damaged and passage has been provided earlier to give connectivity to the persons who were disconnected during flash floods of March, 2015 as per instructions of the District Administration. DB further directed CE PWD to inspect the entire area and explain the breaches/constructions which have been photographed and are the subject matter of the newspaper report of which suo moto cognizance has been taken by this Court. DB further observed that so far as the status report filed by the vice Chairman, JDA is concerned, it is complained that the land over which the construction of the link road from the fourth bridge to Karnaile Chak has not been demarcated and handed over till date to the authority by the Revenue Department despite communication dated 9th of March, 2019. Upon this DB issued notice to the Secretary, Department of Revenue, State of Jammu and Kashmir to explain as to why the action has not been taken, as requested by the JDA in letter dated 9th of March, 2019. DB also appointed Adv Mohsin as a local commissioner to inspect the 4th Tawi Bridge, to visit the spot and submit a report to this Court upon a physical verification of the 4th Tawi Bridge with regard to the subject matter of the writ petition. DB also directed court counsel to place before it the photographs of the existing position and also indicate on a site plan as to what is the exact position on the ground. |
