Court acquits cop facing trial in NDPS

JAMMU, Aug 27 (JNF): Principal Sessions Judge Rajouri Jaffer Hussain Beigh acquitted Mehboob Qadir S/O Ghulam Qadir R/O Thanaang Tehsil Darhal, District Rajouri who is police cop and facing trial in NDPS case for the last five years as prosecution has not succeeded in proving the guilt of the accused.
Court observed that when there is no direct evidence of the prosecution on record that the articles were recovered from the accused person, there is no need to discuss the evidence of prosecution witness who has brought the weighing machine and weighed the articles or resealing of packets.
According to prosecution case in brief is that on 29.04.2015 at about 8.30 p.m Head constable Mohd Gafoor No.367/R along with Constable Imran Ahmed No.1404/R, Saruf No.532/R , Jahid Iqbal No.1419/R while on Patrol Duty in the market of Darhal reached at Bus Stand near Boys Secondary School, saw the accused having a bag in his hand fleeing away from the spot. The said persons was caught by the police persons on suspicion basis who disclosed his name as Mehboob Qadir and during his personal search a bag containing 12 Corex bottles of 100ml each, 09 strips of Parvonspas capsules containing 88 capsules and about 15 or 20 grams of charas in the cigarette packet were recovered and seized by Head Constable Mohd Gafoor where after a docket through constable Imran Mehmood No.1404/R was sent to police Station Darhal. On receiving the docket FIR No.44/2015 for offences u/s 8,20,21,22 of NDPS Act & 18/27 of Drugs and Cosmetics Act was registered and investigation of the case started. JNF
