Five years RI to four in assault case

JAMMU, Nov 23: Principal Sessions Judge Samba MA Chowdhary awarded five years rigorous imprisonment to Vinod Singh @ Binny, Sushil Singh @ Sonu @ Fuss, Lakhvir Singh @ Lucky and Anil Singh @ Resoo in murderous attack case.
An information was received at Police Station Samba on 30.04.2008 at 1845 hours from reliable sources that one Vinod Singh @ Bunty, who was riding a motorcycle, was attacked by Vinod Singh @ Binny S/O Kuldeep Singh R/O Dargalian Ward No. 3 Samba, Anil Singh @ Resoo, Lakhvir Singh @ Lucky S/O Kuldeep Singh R/O Mandi Thalora Samba, with sharp edged weapon like khokhari etc; that in this murderous attack, Vinod Singh @ Bunty sustained grievous injuries on his legs, hands and shoulder with sharp edged weapons and that the assailants had fled away; that injured had been shifted by some pedestrian to Samba hospital for treatment. On this information, a case was registered at Police Station Samba vide FIR No. 96/2008 for the commission of offences punishable U/Ss 307/341/323/34 RPC and after completion of investigation challan was presented in the Court.
Principal Sessions Judge Samba after hearing Public Prosecutor Jawad Ahmed Khawaja for the police whereas Adv Sudershan Khanmotra for the accused persons observed that young age of the convicts and their having no criminal background cannot be lost sight of, but the injuries which have been sustained by the injured and the act of the convicts voluntarily causing grievous hurt by dangerous weapons, after restraining the injured also cannot be overlooked. As per the convicts, they are only male family members and they have to look after their old age parents and the young children. They have been facing the trial for over more than ten years. Keeping in view all the facts and circumstances and balancing the aggravating and the mitigating circumstances, the ends of justice is that each of the convicts namely, Vinod Singh @ Binny, Sushil Singh @ Sonu @ Fuss, Lakhvir Singh @ Lucky and Anil Singh @ Resoo are sentenced to undergo rigorous imprisonment for a term of five years and also to pay fine of Rs 25,000 for the commission of offence punishable under Section 326 RPC and in case of default in paying the fine, the defaulting convict(s) shall undergo further imprisonment of six months. They are further sentenced to undergo imprisonment for a period of one month and fine of Rs 500 for the commission of offence punishable under Section 341 RPC and in case of default in paying the fine, the defaulting convict(s) shall undergo further imprisonment of seven days. Both the sentences of imprisonment, however, shall run consecutively. —JNF
