Court rejects bail in NDPS Act

JAMMU, Dec 1: Principal Sessions Judge Samba MA Chowdhary rejected the bail application of Punjab Based Narco Smuggler.
While rejecting the bail application of Rashpal S/O Ram Lal R/O Nangal Bhur, Tehsil and District Pathankot, Punjab, Principal Sessions Judge Samba MA Chowdhary observed that Public Prosecutor filed his objections alongwith police report, asserting therein that the accused has committed the offences punishable U/Ss 8/15/25 NDPS Act, which are non-bailable and heinous in nature, as such, he cannot claim bail as matter of right; that the accused was arrested on 28.10.2020 by concerned police when 1.800 kilograms poppy straw, which falls in intermediate quantity, was recovered from him; that investigation is at initial stage and without the presence of accused, it is very difficult to investigate the case; that the accused person has indulged in the smuggling of narcotic drugs for selling to innocent youth, making them addicts, causing damage to their health and spoiling the lives of young generation; the applicant does not deserve any leniency, as admitting him to bail will amount to encouragement to repeat such offences.
Court further observed that investigation of the case is under progress and the chargesheet against the applicant is yet to be laid in the court of law. Therefore, in my considered opinion, having regard to the facts and circumstances of the case, particularly the serious nature of offence, the applicant is not entitled to grant of bail, at this stage.
