Court pulls up Police for not filing FIR in land dispute case

Jammu, Nov 27: A court has pulled up the police for not registering an FIR in a case pertaining to an alleged thrashing of a family in Bishnah area.
Judicial Magistrate Ist class, Bishnah Ananta Raina, passed an order stating: “Present application has been moved by the counsel for complainants let it be diarized. Along with the complaint copy of the application forwarded to police officials, medical record of the complainants & photographs of the injured are also placed on record. The complaint is annexed with an affidavit of the complainant. Perusing the contents of the application, there is sufficient material to presume at this stage that accused persons have committed cognizable offence and police has not taken any action. Applying my mind to the facts of the instant complaint it is dear that the complainant had approached the concerned Police authorities for lodging FIR but without any specific reasons, nothing has been done. Therefore, in view of these circumstances I deem it proper to direct SHO, PS Bishnah to register FIR against the accused persons and investigate the matter under the provision of law.”
Talking to the reporters at Press Club here Advocate Vandana Kumari said that despite the court order Bishnah Police have not registered a case against the accused, who attempted to murder his client.
Advocate Kumari is representing a family of village Chak Chima of Bishnah Tehsil. The victim’s family was allegedly attacked by their relatives over a land dispute.
“On 23rd of November at 8:30 pm nine people vis Sukhdev Singh son of Laxman Singh, Asha Devi wife of Sikhdev Singh, Saru Dhogal daughter of Sukhdev Singh, Ashu son of Sukhdev Singh, Kirti daughter of Ranjeet Singh, Ratno Devi wife of Laxman Singh, Viay Singh son of Ghadarv Singh, Laxman Singh son of Dhumal Singh and Archala wife of Ranjeet Singh all resident of village Chak himna Tehsil Bishnah, stormed into house Jagdev Singh and attacked on him and his wife Nirmal Bhogal”, Advocate Kumari told reporters at Press Club Jammu.
“All the accused mercilessly thrashed the victim and Police instead of listening to my client, joined the accused and thrashed the victim,” Advocate Kumari alleged.
“After being attacked by the accused persons, the clients called the Police, but instead of listening to them , SHO abused them on the telephone.
We have recorded the phone calls. When Police reached on the spot, five cops including SHO Bishnah, also joined the accused and dragged the victim family”, she said, alleging “The Police team also stole Rs 60,000 from the pocket of Jagdev Singh and also took away his Mobile phone.”
“Bishnah Police are hand in glove with accused persons, instead of registering our complaint.
They implicated us in a false case, and also named my sons who were not at home at the time of incident, both were in Bari Brahmana”, alleged Nirmal Bhogal, adding that his son directly went to Police station Bishnah from Bari Brahmana, but Police did not register the complaint.
Advocate Kumari said, “Police seem least bothered even though the Court has passed an order for registration of a case against the accused.”
Meanwhile, SHO Bishnah said that the case was registered before the order was issued by the Court, however, he did not share the FIR number and names of the accused.
