JAMMU, Aug 30: In a petition filed by Forum of Investors in Online Bike Boat Scheme who were duped of the financial investment made by them in response to an offer made by the M/s Garvit Innovative Promoters Limited (Bike Boat) Company located at Plot No. 1, Village Chiti, District Gautam Buddha Nagar, Uttar Pradesh, Noida UP, alleged to be run and managed by the respondents as being the alleged directors of respondent s Garvit Innovative Promoters Limited (Bike Boat) and all of them being the residents of State of UP.
Justice Rahul Bharti of Jammu & Kashmir High Court after hearing Adv Anuj Dewan Raina, observed that this Court in recognition of the fact that an alleged act of crime, and which too is of nature of the financial fraud, needs an investigation and cannot suffer delay for even getting registered at the instance of the aggrieved person(s), so this Court directs that in the event of Suresh Kumar Bhat S/o Lambodar Bhat R/o H. No. 308, Sect. 3, Ext. Vasant Vihar, Trikuta Nagar, Jammu as being the representative of the Forum of Investors in online Bike Boat Scheme approaches the Central Bureau of Investigation, Anti-Corruption Bureau Ghaziabad with a complaint then said compliant be diarized as FIR by the Central Bureau of Investigation, Anti-Corruption Bureau Ghaziabad so as to undertake and proceed ahead with the investigation in the matter as is being done in cases of identical nature.
The nature of the criminal fraud allegedly suffered by the individuals forming the petitioner at the hands of the respondent no. 9 that is M/s Garvit Innovative Promoters Limited (Bike Boat) Company is that the respondent no. 9 had come forward with an advertisement in the public domain offering a scheme inviting the public to invest an amount of Rs. 62,100/- as price of one bike with the respondent no. 9 which in turn would return to the given investor on monthly basis of an amount of Rs. 5,175/- for a period of one year plus crediting an amount of Rs. 4,590/- to the said investor as a rental income of the bike so purchased on the basis of the investment so made in favour of the respondent no. 9. To put it in simple words, as against one time investment of Rs. 62,100/- a prospective investor was to get a monthly return of Rs. 9,765/- for 12 months in recurring plus the bike. This advertisement had laid many gullible persons to become investors and found their investment getting lost at the hands of the respondent no. 9 and its promoters who are said to be respondent nos. 10 to 15.
It is in this scenario that number of duped investors got together to act as a forum in the name of the petitioner for the purpose of pursuing a legal battle to bring to book the wrong doers operating in the name of respondent no. 9 that is M/s Gravit Innovative Promoters Limited (Bike Boat) Company.
