HC dismisses bunch of petitions on admission regularization

Jammu, Aug 24: A bunch of petitions filed by Association of ETT Students and others institution of ETT seeking regularization of admissions of students, Justice Ali Mohd Magrey has dismissed all the petitions by common judgment. In all the petitions, the facts pleaded are more or less identical and the petitioners have sought direction to respondents to regularize the admission of students made by the petitioner institutions of their own during the session 2011-2013 and to allow them to sit in the examination conducted by the BOSE.
Justice AM Magrey after hearing a battery of lawyers appearing for the both the sides observed that a perusal quoted passage of the document, relied upon by the counsels, does not in any manner make out that there was any agreement or assurance extended by the BOSE that the admissions of such students would be regularized. Court further said that it could be best be said, though not expressly contained in the aforementioned passage of the document, that it was in principal agreed that the BOSE would examine the eligibility of such students.
Even if it be taken as an agreement, it does not mean that such eligibility would be determined in abstract; naturally, such examination could not be dehorse the regulations/ calendar of the BOSE.
Justice AM Magrey further observed that in all the petitions, the petitioners have failed to establish any rights or violation thereof which would be entitle them to maintain these petitions or warrant issuance of the directions prayed for in these petitions and dismissed all the petitions. (JNF)
