| HC grants interim bail to Peerzada's foster son | | | Jammu, Jan 6: Vacation of Judge of J&K High Court Jammu Wing Justice BL Bhat today granted relief to Foster's Son of Cabinet Minister Peerzada Mohd Syed, who was allegedly involved in copying during his matriculation examination two years ago. Justice BL Bhat of J&K High Court after hearing Advovate UK Jalali with Advicate Anuj Sawhney appearing for the petitioner Imam Souban Bhat (foster son of Cabinet Minister Peerzada Mohd Syed) granted pre-arrest bail. In the petition it has been submitted that petitioner has been alleged to have committed offence punishable u/s 419/420/467/468/120-B of RPC and 5(2) of PC Act. According to the FIR NO 1/2014 registered by Crime Branch Kashmir it was alleged that one candidate namely Imam Soban Bhat had restored to use of unfair means during conduct of 10th class examination in connivance with his Supervisory board of staff etc. On receipt of the complaint a preliminary enquiry was initiated in crime Branch Kashmir. During the enquiry the crime branch found that the ommisison and commission on the part of Tariq Gellani, Mehraj-ud-Din Zargar, Imtiyaz Asgram and Imam Soban Bhat and some other persons prima-facie constitute offences and registered a formal case. After registration of case, Imam Souban Bhat (foster son of Cabinet Minister Peerzada Mohd Syed) today filed anticipatory bail in the High Court at Jammu Wing. During the course of argument Sr. Adv UK Jalali submitted that petitioner is said to be pursuing law studies and is required to appear in 3rd semester and one back log of 1st semester scheduled for 7th, 8th and 23rd of January, 2014. It is also submitted that the petitioner was a minor aged 16 years at the time of alleged offence. Justice BL Bhat observed that without commenting upon the allegations leveled against the petitioner and without looking into the materials that may have been assembled in support of such allegations, is of the considered opinion that in view of the fact that the occurrence is four years old and the petitioner is a student who has to appear in examination brief respite can be granted till the petitioner files a proper bail application before the competent court and disposed of the bail application by directing that petitioner in the event of being arrested in FIR No 1/2014 of P/S Crime Branch Srinagar shall be released on furnishing of surety and personal bonds in sum of Rs 20,000 each with the direction that this direction remain in force till January 31, 2014 and the petitioner may approach competent court6 before January 31, 2014.
