Sher-e-Kashmir's biographer `plays' fraud, sells already sold JDA plot; court directs status quo

JAMMU, Aug 16: Mohammad Yosuf Teng, Sher-e-Kashmir's biographer and ex MLC of National Conference, allegedly played fraud in the shape of selling plot which is already sold to aggrieved person , however, aggrieved person knocked the door of court and court in terms ordered status quo keeping in view to protect the aggrieved person from irreparable loss and to preserve the suit property. Earlier, the aggrieved lodged complaint with the Trikuta Nagar police in this connection.
One Rohit Mahajan son of Ramesh Chander Mahajan of sector 5-A, Trikuta Nagar filed plaint before court stating that he purchased the plot No 1-P measuring 60'x90' situated in sector 5, Roop Nagar, JDA Housing Colony from Mohd Yosuf Teng son of Abdul Razak Teng of H.No 311, E.P Flat Wazarat Road, Jammu. The ex MLC shown the papers of his allotment with regard to the said plot to him and it was agreed by him to sell the same plot to him for construction amount of Rs 40 lakh out of which he paid an advance amount of Rs 15 lakh to the ex MLC after executing an agreement to sell. As per agreement the ex MLC had to take NOC from the JDA authorities for registration of the conveyance deed, but he was delaying the matter on one pretext or other, later he came to know that ex MLC is trying to sell the plot in question which he has already sold to him, the complainant alleged.
Meanwhile, the City Judge after going through the plaint observed, "I have gone through the annexure enclosed with the plaint. The plaintiff seems to have a prima facie case and balance of convenience at this stage lies in favour of the plaintiff. The Ld Counsel for the plaintiff has submitted that the matter is of emergent nature and has made a prayer for dispensation of notice to defendant. Notice is dispensed in view of the emergency urged by the plaintiff and his counsel in order to protect the plaintiff from irreparable loss/injury and in order to preserve the sit property, parties are directed to maintain status quo with respect to creating third party in the suit property this order shall however, be subject to the objection of the other side and further subject to the condition that the plaintiff shall serve copy of this order, plaint, application, affidavit and documents annexed with the plaint forthwith to the defendant/non applicants personally or through registered post and shall file an affidavit on 18.8.2014".
Meanwhile, ex MLC M.Y Teng when contacted refuted the allegations leveled against him. He said that he had never executed any agreement with any person for selling of his plot. He further said that if any person has any agreement to sell then it must bear his forged signature, adding, he is going to lodge FIR against the said person for forgery and would urged the court to send so called agreement to FSL to make access of the authenticity of his signature.
