JKHCBAJ demands abolition of Article 35 A
8/3/2018 11:15:25 PM
Early Times Report
JAMMU, Aug 3: A meeting of General House of J&K High Court Bar Association (JKHCBAJ), Jammu, was held under the presidentship of BS Slathia, Sr Advocate, in the Conference Hall of District Court Complex, Jammu, which lasted for more than three hours for holding deliberations on the listed agenda items.
At the outset, Slathia informed the members about the closing of Suo moto proceedings initiated by the Supreme Court on July 30 last which were initiated in view of the motivated and malicious campaign by some section of national media to tarnish the image of the Association. The members of the Association in one voice thanked and appreciated the role played by the senior advocates Vikas Singh, (President Supreme Court Bar Association), Sidharth Luthra Sr. Advocate and Bimal Roy Jad, Advocate on record who successfully represented the aspirations of JKHCBAJ. The members unanimously decided to felicitate the said lawyers and AOR who have extended their pro bono services to the Association. The members present also appreciated the role of office bearers who untiringly made every possible effort to protect the interest and integrity of the Association and successful culmination of the litigation in the Supreme Court.
Regarding Article 35-A of the Indian Constitution, Slathia stated that the Presidential Order can't be an Article of Indian Constitution. He emphasized to abolish Article 35-A to establish gender equality.
Expressing grave concern over the insistence of certain leaders in Kashmir, including separatists, that Article 35-A should not be abolished, Slathia asked to defeat those who oppose gender equality, equality of status between the people of J&K and their fellow Indians, grant of citizenship to refugees from Pakistan living in Jammu since 1947 and mislead the people of Kashmir by saying that the issue of accession will be reopened, if Article 35-A was repealed.
The JKHCBA president also expressed solidarity with the daughters of J&K married outside J&K to non-permanent residents of J&K whose children and spouses do not enjoy any citizenship right in J&K.
