Jammu, Oct 16: Principal Sessions Judge Jammu Vinod Chatterji Koul awarded 10 years imprisonment and fine to Anuj Trikha s/o Parbat Kumar Trikha R/O House No: 5, Lane No: 5, K.B Colony, Bantalab, Jammu.
The accused has been prosecuted for the offences punishable under sections 420, 467, 468, 170 RPC by the police of P/S Gandhi Nagar, Jammu. The allegations against the accused are that on 17.3.2009 one application through post was received in the Police Station Gandhi Nagar, Jammu from the complainant AEE, PHE Sub Division Gandhi Nagar, along with two applications of Kulwant Singh and Brij Raj Singh and two Photostat receipts of PHE Department, for lodging FIR against some people collecting water tax through fake receipts, thereby causing a loss to State Exchequer. On receipt of this application FIR No: 93/2009 for offences punishable under sections 420, 467, 468 RPC was registered against the accused and on the conclusion of the investigation accused was found to have prepared fake receipt book and collected water tax from different people on the basis of fake receipts and committed offences punishable under sections 420, 467, 468, 170 RPC.
Principal Sessions Judge Jammu Vinod Chatterji Koul after hearing Public Prosecutor Rakesh Badyal for the state whereas Adv Manohar Singh for the accused observed that the accused is found guilty of the offences punishable u/s 420, 467, 468, 170 RPC and ordered that the adequate sentence commensurate with the level of his guilt would be simple imprisonment for a period of one year u/s 170 RPC. He shall also undergo simple imprisonment for a period of three years and fine of Rs. 2000/- u/s 420 RPC and in case of default in payment of fine, he shall undergo a further simple imprisonment for 01 month. He shall also undergo simple imprisonment for a period of three years and fine of Rs. 2000/- u/s 467 RPC and in case of default in payment of fine, he shall undergo a further simple imprisonment for 01 months.
He shall also undergo simple imprisonment for a period of three years and fine of Rs. 2000/- u/s 468 RPC and in case of default in payment of fine, he shall undergo a further imprisonment for 01 month. However, all sentences shall run concurrently.
