Court rejects bail of two allegedly involved in attack on police party

JAMMU, Oct 23: Additional Sessions Judge Jammu rejected the bail application of two accused allegedly involved in an attack on police party.
Additional Sessions Judge Jammu SL Lalhal rejected the bail plea of Sunil Kumar, son of Janak Raj of Bhagatpur Ghou Manhasan Jammu and Gagan Kumar, son of Karam Chand of Bhagatpur Ghou Manhasan Jammu who were allegedly involved in an attack on police party.
Additional Sessions Judge Jammu after hearing Adv Deepika Singh Rajawat appearing for the applicant observed that that on August 20 last, a patrolling party of PP Pouni Chak was attacked by a group of 7-8 people with an intention to kill them and the assaulters had fled with weapon of one of the officials.
FIR No 298/2018 for commission of offences u/ss 307, 353, 382, 332, 147, 148 & 120-B RPC & 4/25 Arms Act is registered at P/S Domana, Jammu. The perusal of the police report further reveals that the present applicants/accused are absconding after the commission of alleged offences and the weapon of offences are yet to be recovered from them. Court further observed that the Act in which the present applicants/accused are involved, are heinous in nature and if the present applicants/accused are admitted to bail, the recovery of the weapons of offence may not be affected and thus, the investigation of the case may be scuttled. In these circumstances, if the present applicants/accused are admitted to bail, the prosecution case may be seriously prejudiced. With these observations Court rejected the bail application.
