Srinagar, Feb 7: As Administrative Officer of Sher e Kashmir Institute of Medical Sciences (SKIMS) failed to assist Public Information Officer (PIO) to provide information to an aggrieved Additional Professor working in the same institution, the matter was taken seriously by the State Information Commission (SIC) and a penalty notice has been issued against the officer.
Details available with Early Times reveal that an RTI application dated 20-06-2018 was filed Dr Shyam Singh Additional Professor CVTS SKIMS. Dr Singh sought to know Reasons for not promoting the applicant to the post of Professor Cardiovascular & Thoracic Surgery SKIMS under AMPS , Copies on minutes of meeting of Apical Selection Committee made in its series of meetings conducted in between July 18, 2017 and May 15, 2018, Copies of recommendations of the meetings as mentioned above, name and addresses of members of Apical Selection Committee and also the names and addresses of Experts for CVTS interview held on 26th of August, 2017 , copies of Award roll of the interview of CVTS for AMPS, and copies of ACRs of the applicant forwarded to Apical Selection Committee.
The PIO/ HOD Hospital Administration vide his communication dated 21-06-2018 sought the assistance of Administrative Officer (Policy), SKIMS. Vide communication dated 31-07-2018, the PIO informed the appellant that the matter was taken up with Administrative Officer (Policy), SKIMS and he has informed vide his communication dated July 24, 2018 that the main file is under consideration. As soon as the file is received from the competent authority, the desired information will be provided. Aggrieved by this response of the PIO, the appellant filed subsequent appeals.
SIC in its order 15.01.2019 said that the Adm. Officer (P) was under an obligation in terms of section 5(5) of JK RTI Act 2009 to render such assistance to the PIO as expeditiously as possible so as to enable 9 the PIO to dispose of the request for information within 30 days as specified under section 7(1) of the Act.
"The Registrar of this Commission is directed to serve a show cause notice upon Dr. Ghulam Nabi, Administrative Officer (Policy) SKIMS, Soura directing him to explain as to why penalties as envisaged under section 17 of the J&K RTI Act, 2009 shall not be imposed upon him for not rendering necessary assistance to the PIO/HOD, Hospital Administration enabling him to dispose of the RTI request of the appellant within the period specified under section 7(1) of the Act. He shall be directed to file his written statement of defence/reply to the show cause notice within a period of 15 days from the date of issue of the notice" The SIC ruled.
