DB implead UOI as party in PIL regarding infrastructure for cancer patients

Srinagar, May 2: In a Public Interest Litigation filed by Rabia Khurshid regarding shortage of infrastructure for cancer patinents, A Division Bench of Stae High Court Comprising Justice Ali Mohammad Magrey and Justice Tashi Rabstan impleaded party respondent Union of India through Secretary to Government Health and Family Welfare Department Government of India as in the response filed by the State the required steps for ensuring treatment of cancer patients has reference to release of funds by Health and Family Welfare Department, Government of India. DB also issue notice to newly impleaded respondent to file response. The court was hearing a public interest litigation petition seeking implementation of guidelines for strengthening the tertiary care of cancer as provided by government of India. Rabia has undergone five surgeries relating to cancer on various occasions and contends the state government has failed to provide any proper infrastructure or assistance due to a citizen in a welfare state. In her plea she seeks directions for construction of operation theatres in the upcoming state cancer institute as per the proposed requisition. She also pleads for making available operation theatres for the department of surgical oncology for all seven days in the week. Pertinently, according to petition, Jammu and Kashmir has witnessed an unprecedented 87 percent rise in cancer cases during last 7 years. According to the PIL due to shortage of operation theatres assigned to the department of surgical oncology, surgeries are performed only twice a week which causes deaths for want of timely surgeries. The petitioner pleads that certain structural flaws were pointed out in the building of state cancer institute and forwarded to the concerned authorities, but the flaws were not rectified. (JNF)
