ISSUANCE OF DOMICILE CERTIFICAE TO WEST PAKISTANI REFUGEES SETTLED IN J&K

Chairman West Pakistani Hindu Refugee Front (WPHRF), Sub Maj (Retd) Madan Lal Dubgotra discussed the issue of Domicile Certificate to West Pakistani Refugees (WPRs) with the Executive members of the Front. He stated that demand of the WPHRF for issuance of Domicile Certificate to WPRs submitted to PMO under Registration No PMOPG/E/2018/ 0319838 dated 01.7.2018, to facilitate them to avail benefits of Central Sponsored Schemes; like, Prime Minister Special Scholarship Scheme (PMSSS), Ladli Beti, Beti bachao and Beti Padao and Subsidized loans under Make in India, Schemes after due consideration has been sent to J&K Govt for appropriate action. These WPRs were migrated from undivided India, from the Area now in Pakistan on partition of India during 1947 and settled in J&K being residing very close on other side of J&K Border. The WPRs are still not considered as Permanent Residents of J&K in accordance with Section 6 of Constitution of J&K, inserted vide amendment Act 1965 and accordingly are denied all Fundamental and Human Rights as applicable to residents of J&K. WPRs are denied benefits of all Central Sponsored Schemes including PMSSS, besides denying jobs in J&K Govt., Scholarship, Admission to professional and Higher Education courses, right to Vote for Assembly Elections and they cannot own any immovable property under the Law, in accordance with Section 6 of the Constitution of J&K. The Govt of India, Ministry of Home Affairs, after due consideration have forwarded the Grievances to The Revenue Secretary, J&K Govt vide letter No 35/27/2019-R&SO(CF N0 3456255) dated 22 April 2019 (Copy enclosed), for appropriate action in the matter for issuance of Domicile Certificate to WPRs. Chairman WPHRF requests the Hon’ble Revenue Secretary for early consideration of the issue regarding issuance of Domicile Certificate to WPRs so that their wards can avail benefit of PMSSS for the current session 2019-20.

Earlier the Centre Govt. has been very kind to consider demand of the WPHRF for 5.5. lakhs one time settlement relief to WPR families who migrated to J&K during 1947 (ie. Old WPR family), at par with POJK Refugees on considering the demand projected by the Chairman of the Front, alongwith other demands to the PMO and the Home Minister. The other demands included in the memorandum are Monthly Cash relief of Rs 10000/- per month, per family, as being paid to KP migrants till WPRs are considered as Permanent Residents of J&K and all benefits as applicable to Permanent Residents of J&K are extended to them. The Memorandum includes the demand for compensation of Rs 1,00,00,000/- (One Crore) to each WPR family to compensate the loss inflicted to these families during last 70 years due to Article 35A of Constitution of India, included in the constitution through Presidential order, violating constitutional provisions which facilitate J&K Assembly to define Permanent Residents of J&K vide Section 6 of Constitution of J&K to deny all fundamental and human rights including Jobs in J&K Govt, Scholarships, admission to Professional and Higher education courses, besides denying voting right in the State Assembly thus the political representatives also neglected these WPRs having no vote value.

Earlier the Centre Govt have also been very kind in restoration of Recruitment in Central Forces from April 2016 on the representation of Chairman WPHRF, which was otherwise stopped by Previous Centre Govt. from 2005. Prior to 2005, wards of WPRs were being enrolled in the Central Forces regularly since 1947 on production of Residential certificate signed by Sarpanch of the concerned Village. This provision was withdrawn by the Centre Govt during 2005, rendering the WPRs ineligible even for enrolment in Central Forces, while these WPRs are Citizens of India and valid voters for the Parliamentary Election, hence very much entitled for the recruitment in the Central Forces. Denying the WPRs enrolment in Central Forces by Central Govt, in violation of all Human and Fundamental rights granted under Constitution of India.
