Jammu, May 11: In the much publicized Rubiya Sayeed case and killing of five Air Force personnel, in which JKLF chairman Yasin Malik is one of the accused, the TADA court on Saturday directed counsel for the CBI to produce copy of High Court order in which the court had vacated the stay.
When the matter came-up for hearing, the counsel for the CBI presented in the court submitted that the High Court had dismissed the petition filed by Yasin Malik and others and had vacated the order of stay. The court directed counsel for the CBI to produce the order copy and fixed May 21, 2019 as the next date for hearing.
On December 8, 1989, Rubiya Sayeed, daughter of the then Union Home Minister Mufti Mohammad Sayeed was kidnapped while she was travelling in a mini bus towards her house from Lala Ded Hospital Srinagar and taken to some unknown place by some militants belonging to the JKLF. On September 18, the charge sheet in this case was filed by CBI. During the course of trial a petition was filed on October 25, 2008 for transfer of the case to the designated TADA court in Srinagar. Objections to the application were filed by the CBI and after hearing both the parties the application was rejected vide order dated April 20, 2009 against the said order of trial court. The petitioners then approached the High Court at Srinagar on April 30, 2009 and the High Court stayed the proceedings of the trial court.
