Court reject bail of alleged cheater

Jammu, May 25: Sub-Judge Jammu Pawan Kumar Sharma rejected the bail application of Ashok Kumar Sharma alleged cheater booked by the Crime Branch.
According to the report filed by the Crime Branch that a FIR NO 13/2017 u/s 420/465/466/467/468/471 in which it has been alleged that complainant accused Ashok Kumar Sharma entered into an agreement to sell with complainant on July 30, 2014 with respect to land measuring 2 Kanals at Salalpur Tehsil & District Jammu and also took Rs 5 lacs as an advanace amount was to be paid at the time of registration of sale deed. The report further reveals that the accused failed to execute the sale date and neither returned back money to the complainant. On this Crime Branch registered a case.
Sub-Judge Jammu Pawan Kumar Sharma after hearing Sr. PO Puja Nijhon observed that it is well setteled law that grant of bail by a court may a question of discretion, but the same is to be exercised judicially after keeping in view of the nature of offence the punishment for alleged offence, the chances of the accused further committing such offence and the chance of the accused threatening or influencing the witnesses. With these observations Court rejected the bail application.
