Reverting Article 370 back- ruled out totally
9/1/2019 9:51:26 PM

Ravi Bhushan Suri

On Wednesday, the Governor Satya Pal Malik, while announcing of 50000 jobs for the youths in the state to be filled up within 2-3 months time, declared that there is question of restoring the Article 370 back which stands abrogated by the Indian Parliament on August 5 by the two third majority thereby bifurcating the state of Jammu and Kashmir into two UTs - J&K UT and Ladhakh UT. The Article 370 has done a great loss to the people of the state in the last seven decades thereby putting the Integrity and the Sovereignty into danger and the great risks at the hands of our enemy Pakistan. Due to this Article, the state had suffered a lot over the decades as the Kashmir Centric leaders exploited the poor people of the state for their personal gains and had instigated the youths of the state for joining the militancy in the valley by keeping their eyes on Pakistan only. Several individuals, NGOs or the some political parties have gone to the Apex Court in challenging the abrogation of the Articles 370 and 35 A from the Indian Constitution by an Act of the Indian Parliament on August 5 and sought for the justice from the court.
In fact, they have prayed for the restoration of the special status to J&K as guaranteed by the Indian Constitution earlier. The Chief Justice of India has referred the issues involved to the Special Bench comprising of 5 Judges of the Supreme Court of India for adjudication in the right earnest. The Supreme Court of India has deferred the matter for the hearing in the first week of October in the light of the fact that the Reorganization of the state of Jammu and Kashmir into two UTs- J&K UT and Ladhakh UT which shall start functioning from October 31 and onwards as approved and okayed by the Indian Parliament on August 5
The opposition political parties of the state and the country as well are alleging that there exists the total lull, chaos and confusion in the matter of law and order situation in the state and whereas on the contrary, the Governor Satya Pal Malik claimed that every thing is normal in the state as there exists total calm and peace in the state after the abrogation of the Articles 370 and 35A from the Indian Constitution by the Indian Parliament on August 5. After the abrogation of the Articles 370 and 35A from the Indian Constitution by the Indian Parliament on August 5, several restrictions were imposed by the Divisional and the District administrations in the state and subsequently are being lifted out one by one, The Governor Satya Pal Malik claimed that the imposed restrictions remained useful in restoring the peace and calm and in maintaining the law and order in the valley. Almost all the heads of the political parties including the 3 former Chief Ministers of the state- Dr. Faeooq Abdullah. Omar Abdullah and Mehbooba Mufti have been taken into custody and made them under the house arrests besides taking the former top IAS officer turned politician stands arrested under PSA after detaining him at the IGI Airport New Delhi.
As of now, they are not released yet as the Divisional and the District administrations in the state are having the apprehensions that in case the detained leaders are released, the law and order situation in the valley may go bad. Their individual cases are being scrutinized so that they may be released soon after having filed the surety bonds on oath to the Divisional and the District administrations in the state stating therein that they will not enter into any controversy or instigating the people of the state against the governmental set up under the command and control of the Governor Satya Pal Malik.
Pertinent to mention here that the Article 370 was inserted in the Indian Constitution on 1952 by the act of the Indian Parliament which guaranteed the special status to the J&K state, At that time Pandit Jawahar Lal Nehru was the Prime Minister of India and Sheikh Mohammed Abdullah became the Prime Minister of J&K state. Later the Constituent Assembly of the state adopted the J&K Constitution and its Flag on which stands scrapped by the President of India after the abrogation of the the Articles 370 and 35A from the Indian Constitution by the Indian Parliament on August 5 and the state of Jammu and Kashmir stands bifurcated into two UTs- K&L UT and Ladhakh UT effecting from October 31.
Done is done and it can not be done now, It is of no use to over the spilt miIk. The country has become nation with one Flag only from August,5 after 67 years. These are the things of the past when the Kashmir Centric Leaders and the leaders of the Separatists and the Hurriayat Amalgamation were exploiting the sentiments the Kashmiri public against the Union Government for their petty interests only.
Now the reverting back over the abrogated Article 370 from the Indian Constitution is totally ruled out by the Union Home Minister Amit Shah also. Under the circumstances , two options are available to the Kashmir Centric Leaders and the leaders of the Separatists and the Hurriayat Amalgamation - either to mend themselves fully in favour of the Indian set up OR they should leave the politics for ever as they would not be given any latitude to speak against the Indian government in the days to come for achieving their goal.
Mass scale killings have already been checked up as is evident from the fact the after the abrogation of the Article 370 from the Indian Constitution, no killing of the innocent person was made by the security forces in the valley. This could be possible only because of the handling of the law and order situation in the valley by the very competent Governor Satya Pal Malik.
The political experts of the country are of the opinion that the Kashmir Centric Leaders and the leaders of the Separatists and the Hurriayat Amalgamation were having the hollow base in the valley as the people of the valley have not revolted or resented against the Indian government and rather preferred to remain within the four walls of their houses. Therefore it is of no use to cry over the spilt milk and rather they should try their best to adjust themselves in the fastly changing circumstances in the valley. When there will be the elections to the J&K UT Legislative Assemblt in the days to come , they will be free to mobilize the public opinion in their favour and the people of the J&K UT will be provided with the free hand to elect their public representative for the J&K UT to plead their cause and the problems in the right earnest.
Seeing the reality of the prevailing circumstances in the valley, they should be proud of to be Indians first without keeping an eye on Pakistan and they shall have to live as Indians and die as Indians otherwise they will not be spared or will not be having any place in the Indian polity. Come what may.
With the fastly changing scenario in J&K with the hectic efforts and the well considered decisions of the present Governor Satya Pal Malik under the dynamic leadership of the PM Modi , they if elected would not be having the control of the state Police as as per the practice, the Police force headed by the present DGP ( likely to be re-designated as the Police Commissioner) shall be directly under the control of the Lieutenant Governor of the J&K UT like New Delhi. Owing to this, they ( Kashmir Centric Leaders) won't be able to crush their political opponents and at the same time, there will not be any sort of discrimination with the Jammu region due to which the people of the Jammu region had suffered a lot in the past in the matters of the appointment into the State Government, admissions in the Professional Educational Institutions and the issues relating to the overall development of the Jammu region.
It has been learnt from the reliable resources that these days presently the Union Government is going to initiate the delimitation process of the Assembly seats for the J&K UT very soon in making the well balance thereby keeping all the regions of the state on equity basis. This process is likely to get the time of 15 to 18 months for its completion and finalization of the issues involved. After taking its nod from the Union Cabinet, it will be put into momentum and till then no Assembly elections will be held in the state. The Union Government is very much in touch with the Election Commission of India on this score. This means that the Assembly elections to the J&K UT would be held in the year 2021. Up to that time, the leaders of all the political parties of the country would be having the plenty of the time to go to the people of the state to choose their right candidate for the J&K UT Legislative Assembly for representing their cause and the problems in the proposed legislature.
