Court rejects bail in gang rape case

Jammu, Sept 13: Principal Sessions Judge Reasi Kamlesh Pandita rejected the bail applications of Kuldeep and Rinku, who are allegedly involved in a gang rape case.
According to the police case that complainant/prosecutrix lodged a written complaint against the accused persons that they abducted her and thereafter Sonu, one of the co-accused who is absconding, committed rape on her. On the complaint of the prosecutrix case was registered against the accused persons under FIR No 182/2018 initially for the commission of offences under Section 363/109 RPC and investigation was set in motion. During investigation statement of the prosecutirx were recorded under Section 164-A CrPC in which she deposed before the Magistrate that all the accused persons after her abduction committed gang rape on her. After culmination of the investigation accused persons were booked for the commission of offences under Section 376-D/366/34/109 RPC.
Court after hearing both the sides observed that there is no dispute that the accused persons have been charged for the offences punishable under Sections 376-D/366/109 RPC. In this case prosecution has examined prosecutrix, her mother and one of her sister. The offences alleged to have been committed by the accused persons are heinous and also against the society at large. The accused persons facing the trial along with other co-accused persons who have absconded from the trial are involved in gang rape which is an offence against the society and against the person of the victim and leaves an indelible mental scar on the victim. It leaves a festering wound on the soul of the victim that gives a sharp pain at unknown turns. It is a mutilation that triggers the most visceral disgust of the self at most unsuspecting hours. In fact, rape is a seed of trauma that shall unfold in victim's mind for rest of her life. Rape permanently alters a person's existence. With these observations court rejected the bail applications.
