DB directs CE PWD to provide full details to PDJ
PIL regarding road widening from Dalgate to Hazratbal

JAMMU, Oct 3: In a Public Interest Litigation relating to the ongoing road widening programme in Srinagar city from Dalgate to Hazratbal, which commenced way back in the year 2002, a Division Bench of State High Court comprising Chief Justice Gita Mittal and Justice Rashid Ali Dar directed Chief Engineer PWD to give full details of cases to Principal District & Sessions Judge Srinagar.
When the PIL came-up for hearing, DB observed that after perusal of the report filed by Abdul Rashid Malik, learned Principal District and Sessions Judge, Srinagar, would show that no details of the cases as was directed by us in an order dated 23rd April, 2019 has been provided by the Chief Engineer, PWD (R&B).
Upon this DB directed Chief Engineer PWD to file to give full details as was directed in terms of order dated 23rd April, 2019 to the Principal District and Sessions Judge, Srinagar. Thereafter, the Principal District and Sessions Judge, Srinagar, shall file the report before the next date of hearing.
It is worthwhile to mention here that on April 23, 2019, Chief Engineer, PWD (R&B), Kashmir had filed affidavit, indicating the steps taken for ensuring disposal of the cases, pending before the various Courts with reference to subject of the completion of ongoing road widening from Dalgate to Hazratbal.
DB when asked AAG M A Chashoo, about the latest position of the cases, he submits that these cases are still pending decision before the Principal District, Srinagar, Sub Judge/Small Causes Court, Srinagar and this Court. DB directed AAG to furnish the list of the writ petitions to the Registrar Judicial of this Court during the course of week and on receipt Registrar Judicial shall list all those cases before the roster Bench on 21.05.2019 and further directed to ensure completion of the pleadings viz, filing of reply, before the Registry Principal District Judge, Srinagar, shall ensure expeditious decision of the matters having reference to widening of the road from Dalgate to Hazratbal pending before its Court and other Courts of the district, details whereof shall be furnished to him by the Chief Engineer, PWD (R&B) Kashmir during the course of week. In the status report, it is submitted that non-availability of the sufficient funds, the project is yet to be completed and the matter has taken up with the Administrative Department for release of funds.
